<br />(f) Any and all rules and regulations adopted by the <br />San Marcos Electric Utility Board are subject to a <br />written appeal by any rate payer after they have <br />been adopted. Appeals shall be to the City Council <br />of the City of San Marcos. The City Council may, in its <br />discretion, allow the appealing party an opportunity to <br />be heard in person or by a representative. <br /> <br />Sec. 9 1/2-3. <br /> <br />San Marcos Electric Utili ty Line Extension Policy. <br /> <br />The San Marcos Electric Utility Board is hereby authorized and <br />directed to promulgate, revise, amend and supplement the City <br />of San Marcos Electric Utility Line Extension Policy for electric <br />service subject to the following requirements. <br /> <br />(a) The San Marcos Electric Utility Board may propose <br />to the Policy only at a public meeting which is <br />as required by the Texas Open Meetings Act. <br /> <br />changes <br />noticed <br /> <br />(b) Proposed changes must be published twice in a newspaper or <br />newspapers of general circulation in the City and notice <br />of a public hearing must be given with said publications <br />not more than twenty-two (22) days nor less than eight (8) <br />days before the public hearing is held. <br /> <br />(c) Adoption of proposed changes by the San Marcos Electric <br />Utility Board may occur after a public hearing has been <br />closed and not more than thirty (30) days thereafter or <br />the Board must schedule, provide public notice for and <br />conduct a separate public hearing before the proposed <br />changes may be adopted. <br /> <br />(d) Any proposed change that is adopted by the San Marcos <br />Electric Utility Board must be published at least once in a <br />newspaper of general circulation in the City. <br /> <br />(e) No change adopted by the San Marcos Electric Utility Board <br />shall take effect sooner than thirty (30) days from the <br />date of its first publication in a newspaper of general <br />circulation in the City of San Marcos. <br /> <br />(f) Any and all such changes adopted by the San Marcos Electric <br />Utility Board are subject to a written appeal by any <br />rate payer after they have been adopted. Appeals <br />shall be to the City Council of the City of San Marcos. <br />The City Council may, in its discretion, allow the <br />appealing party an opportunity to be heard in person or <br />by a representative. <br /> <br />Sec. 9 1/2-4. <br /> <br />General Authority Of The Board. <br /> <br />The San Marcos Electric Utility <br />general authority as specified below: <br /> <br />Board <br /> <br />shall <br /> <br />have <br /> <br />(a) The Board shall take those actions necessary to provide <br />advice to the City Council with regard to <br /> <br />(1) electric utility rate making; <br /> <br />(2) electric utility <br />improvements; <br /> <br />system <br /> <br />expansion, <br /> <br />enhancement <br /> <br />and <br /> <br />(3) the electric utility system budget; <br /> <br />(4) any and all consultants <br />electric utility system. <br /> <br />and <br /> <br />advisors needed by the <br /> <br />(b) The Board shall work with and provide guidance to <br />electric utility system consultants and advisors within <br />the parameters of the electric utility budget. <br /> <br />(c) The Board shall work with and provide guidance to the <br />Operating Agent, the City Manager and the City <br />Attorney and their staffs with respect to the <br />activities of the San Marcos Electric Utility. <br />
