<br />34 <br /> <br />THE STATE OF TEXAS <br /> <br />USE AGREEMENT <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS: <br /> <br />That the City of San Marcos, Texas, (City) a municipal corporation <br /> <br />existing <br /> <br />by and under the laws of the State of Texas, situated in Hays <br /> <br />County, acting through authority conferred on its Mayor, J.E. <br /> <br />Younger, <br /> <br />by <br /> <br />resolution <br /> <br />duly enacted on <br /> <br />February 9, 1987 <br /> <br />, and the Greater <br /> <br />San Ma rcos Li t tIe League I nc. , <br /> <br />acting <br /> <br />through <br /> <br />its <br /> <br />president, <br /> <br />David <br /> <br />Va Idez , <br /> <br />Jr., <br /> <br />( " League" ) <br /> <br />enter into this agreement upon the following <br /> <br />terms and conditions: <br /> <br />I. <br /> <br />For <br /> <br />and <br /> <br />in <br /> <br />consideration <br /> <br />of <br /> <br />the <br /> <br />construction <br /> <br />by League of a <br /> <br />baseball complex at Ramon Lucio <br /> <br />Park, <br /> <br />located <br /> <br />'vi thin <br /> <br />the <br /> <br />corporate <br /> <br />limits of the Citv of San Marcos, Ci ty ag rees that Leag ue may use the <br />complex for baseball games played under the supervision of League. <br /> II. <br />The use by League of the complex shall be from March 1 through <br /> <br />July 31 of each year. <br /> <br />Should League desire to use the complex <br /> <br />for <br /> <br />an <br /> <br />extended <br /> <br />period <br /> <br />of <br /> <br />time during any year, League may do so only after <br /> <br />obtaining <br /> <br />written <br /> <br />approval <br /> <br />from City prior to July <br /> <br />31 of that year. <br /> <br />The reQuired approval <br /> <br />shall be <br /> <br />incorporated <br /> <br />into <br /> <br />this <br /> <br />Agreement <br /> <br />as a written amendment to the Agreement. <br /> <br />I I I. <br /> <br />The <br /> <br />term <br /> <br />of <br /> <br />this <br /> <br />Ag reeme n t <br /> <br />shall <br /> <br />be for a period of five (5) <br /> <br />years. <br /> <br />The Agreement may be renewed at the end of the five <br /> <br />( 5 ) <br /> <br />year <br /> <br />period <br /> <br />for <br /> <br />an <br /> <br />additional five <br /> <br />(5) year period upon agreement to the <br />
