<br />City Attorney and the cost of same has not been paid by the time <br /> <br />of submission of the file by the Director of Planning to the City <br /> <br />Attorney <br /> <br />for <br /> <br />processing, <br /> <br />or <br /> <br />if <br /> <br />the <br /> <br />City <br /> <br />Attorney <br /> <br />initially <br /> <br />determined that no survey <br /> <br />would be <br /> <br />necessary for the preparation <br /> <br />of a proper legal description and subsequently determined that a <br /> <br />survey would be required, then the cost of same as estimated by a <br /> <br />registered public surveyor selected by the City shall be paid to <br />the City prior to submission by the City Attorney of the <br />abandonment request to the City Council for action thereon. <br /> <br />Likewise, <br /> <br />the amount of the appraised <br /> <br />fair market value of the <br /> <br />subject property shall be paid to the City prior to submission by <br /> <br />the City Attorney of the abandonment request to the City Council <br /> <br />for action thereon. <br /> <br />F. <br /> <br />The City Attorney shall prepare all necessary legal documents <br /> <br />in connection with the request for abandonment including, but not <br /> <br />limited to, the ordinance, deeds, and releases, pursuant to Arts. <br /> <br />1016 and 1017, V.A.C.S., and V.T.C.A., Civil Practice and Remedies <br /> <br />Code, Section 65.015. <br /> <br />G. <br /> <br />Upon <br /> <br />completion <br /> <br />and <br /> <br />execution <br /> <br />of <br /> <br />all <br /> <br />applicable <br /> <br />legal <br /> <br />documents, the City Attorney shall forward the abandonment request <br /> <br />to the City Secretary who shall place the matter on a City Council <br /> <br />meeting agenda <br /> <br />for action thereon. <br /> <br />The City Council <br /> <br />shall not <br /> <br />abandon <br /> <br />any <br /> <br />street, <br /> <br />alley, <br /> <br />or <br /> <br />other <br /> <br />public <br /> <br />real <br /> <br />property, <br /> <br />or <br /> <br />portion(s) thereof until: <br /> <br />-4- <br />
