<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, T'EXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING LOTS 56-61,70-76 AND 78-80 OUT OF THE A.M. RAMSEY
<br />SUBDIVISION OF 32 1/2 ACRES OUT OF THE J.M. VERM1ENDI
<br />LEAGUE # 2, HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME 89,
<br />PAGE 479 OF THE HAYS COUNTY DEED RECORDS; LOCATED AT
<br />101-116 SEGUIN STREET, 205-207 SECOND STREET AND 204-221
<br />THIRD STREET FROM "M" (SINGLE, DUPLEX AND NEIGHBORHOOD
<br />BUSINESS DISTRICT) TO "MR" (MOBILE HOME AND RESIDENTIAL
<br />DISTRICT); AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on October 7,1986, the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change
<br />the zoning from "M" (Single, Duplex and Neighborhood Business District)
<br />to "MR" (Mobile Home and Residential District) of Lots 56-61, 70-76 and
<br />78-80 out of the A.M. Ramsey Subdivision of 32 1/2 acres out of the
<br />J.M. Veramendi League #2, Hays County, Texas, as recorded in Volume
<br />89, Page 479 of the Hays County Deed Records to the City of San Marcos,
<br />Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on October 7,1986, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />of February, 1987, regarding such request; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN

<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"M" (Single, Duplex and Neighborhood Business District) be rezoned
<br />"MR" (Mobile Home and Residential District):
<br />
<br />LOTS 56-61, 70-76 AND 78-80 OUT OF THE A.M. RAMSEY SUBDIVISION
<br />OF 32 1/2 ACRES OUT OF THE J.M. VERM1ENDI LEAGUE #2, HAYS
<br />COUNTY, TEXAS, AS RECORDED IN VOLUME 89, PAGE 479 OF THE HAYS
<br />COUNTY DEED RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on March 9, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 23 day of February, 1987, subject
<br />to reconsideration at the next regular City Council meeting scheduled
<br />for March 9, 1987
