<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, N1ENDING SECTION 3 OF THAT ORDINANCE tmIcH
<br />REGU LATES AND RESTRICTS THE LOCATION AND USE OF BUI LDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING BLOCK 27, LOTS 329-334 AND 368-372 OUT OF THE
<br />WESTOVER ADDITION TO THE CITY OF SAN MARCOS, TEXAS AS
<br />RECORDED IN VOLUME 59, PAGE 184-185 OF THE HAYS COUNTY
<br />DEED RECORDS AND BLOCK 28, LOT 453B OUT OF THE
<br />RESUBDIVISION OF LOTS 452 AND 453, BLOCK 28, WESTOVER
<br />ADDITION TO THE CITY OF SAN MARCOS, TEXAS, ACCORDING TO A
<br />PLAT OF SAID ADDITION OF RECORD IN VOIDME 59, PAGES 184-
<br />185, HAYS COUNTY DEED RECORDS- INTO LOTS 452A AND 453B
<br />BLOCK 28 WESTOVER ADDITION AS RECORDED IN VOLUME 3, PAGE
<br />70 OF THE PLAT RECORDS FOR HAYS COUNTY, TEXAS; BOUNDED BY
<br />THE 1000 BLOCKS OF BISHOP STREET AND ALLEN STREET AND THE
<br />1200 BLOCKS OF HAZELTON AND MARLTON STREET FROM "DP-2"
<br />(DUPLEX DISTRICT-MEDIUM DENSITY) TO "R-l" (SINGLE FAMI LY
<br />DWELLING DISTRICT-LOW DENSITY); AND DECLARING AN EFFECTIVE
<br />DATE.
<br />
<br />WHEREAS, on December 2, 1986, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "DP-2" (Duplex District-Medium Density) to "R-l"
<br />(Sing Ie Family Dwelling District- Low Densi ty) of Block 27, Lots
<br />329-334 and 368-372 out of the Westover Addition to the City of San
<br />Marcos, Texas and Block 28, Lot 453B out of the Resubdivision of Lots
<br />452 and 453, Block 28, Westover Addition to the City of San Marcos,
<br />Texas, into Lots 452A and 453B Block 28, Westover Addition, Hays
<br />County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on December 2, 1986, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />of February, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN

<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"DP-2" (Duplex District-Medium Density) be rezoned "R-l" (Single
<br />Family Dwelling District-Low Density):
<br />
<br />BLOCK 27, LOTS 329-334 AND 368-372 OUT OF THE WESTOVER
<br />ADDITION TO THE CITY OF SAN MARCOS, TEXAS AS RECORDED IN
<br />VOLUME 59, PAGE 184-185 OF THE HAYS COUNTY DEED RECORDS
<br />AND BLOCK 28, LOT 453B OUT OF THE RESUBDIVISION OF LOTS
<br />452 AND 453, BLOCK 28, WESTOVER ADDITION TO THE CITY OF SAN
<br />MARCOS, TEXAS, ACCORDING TO A PLAT OF SAID ADDITION OF RECORD IN
<br />VOLUME 59, PAGES 184- 185, HAYS COUNTY DEED RECORDS- INTO LOTS
<br />452A AND 453B BLOCK 28 WESTOVER ADDITION AS RECORDED IN VOLUME
<br />3, PAGE 70 OF THE PLAT RECORDS FOR HAYS COUNTY, TEXAS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on March 9, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.
<br />
<br />PASSED, APPROVED AND ADOPTED this 23 day of February, 1987, subject
<br />to reconsideration at the next regular City Council meeting scheduled
<br />for March 9, 1987.
