<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING LOTS 26, 27, 28, 29 AND 30 OUT OF THE Z.
<br />WILLIAMSON ADDITION TO THE CITY OF SAN MARCOS AS RECORDED
<br />IN VOLUME 59, PAGE 549 OF THE HAYS COUNTY DEED RECORDS;
<br />LOCATED ALONG THE NORTH CORNER OF THE INTERSECTION OF
<br />MARLTON STREET AND BAYLOR AVENUE FROM "e" (COMMERCIAL
<br />DISTRICT) TO "MF-l (MULTI-FAMILY RESIDENTIAL DISTRICT-LOW
<br />DENSITY); AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on December 16, 1986, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "c" (Commercial District) to "MF-l" 01ulti-Family
<br />Residential District- Low Densi ty) of Lots 26, 27, 28, 29 and 30
<br />out of the Z. Williamson Addition to the City of San Marcos, Hays
<br />County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on December 16, 1986, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />of February, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"c" (Commercial District) be rezoned "MF-I" (Multi-Family
<br />Residential District):
<br />
<br />LOTS 26, 27, 28, 29 AND 30 OUT OF THE Z.
<br />ADDITION TO THE CITY OF SAN MARCOS AS RECORDED IN
<br />PAGE 549 OF THE HAYS COUNTY DEED RECORDS;

<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on March 9, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 23 day of February, 1987, subject
<br />to reconsideration at the next regular City Council meeting scheduled
<br />for March 9, 1987
