<br /> <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VO L. 66) BY <br />ZONING LOTS 1-29 AND 31-32 OF THE CITY VIEW ADDITION TO <br />THE CITY OF SAN MARCOS AS RECORDED IN VOLUME 129, PAGE <br />363 OF THE HAYS COUNTY DEED RECORDS; LOTS 48-59 OF THE J. <br />M. STONE ADDITION TO SAN MARCOS, TEXAS AS RECORDED IN <br />VOLUME 52, PAGE 438 OF THE HAYS COUNTY DEED RECORDS: BIDCK <br />1, LOTS 1-12; BLOCK 2, LOTS 1-15; BLOCK 3, LOTS }-16 OF <br />DAN MCKIE'S FIRST ADDITION TO SAN MARCOS, TEXAS AS RECORDED <br />IN VOLUME X, PAGE 547 OF THE HAYS COUNTY DEED RECORDS; <br />LOCATED ALONG THE 1000 BLOCKS OF DAILEY STREET AND <br />PERKINS STREET AND THE 300-1200 BLOCKS OF GRAVEL STREET <br />FROM "MF-4" (MULTT-FAllILY DISTRICT-HIGH DENSITY) TO "R-l" <br />(SINGLE FN1ILY DWELLING DISTRICT-LOW DENSITY); AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />62 <br /> <br />ORDINANCE 1987- 29 <br /> <br />WHEREAS, on December 2, 1986, the Zoning Commission of the City <br />of San Marcos h~ld a public hearing regarding a request to change <br />the zoning from IIMF-4H (Multi-Family District-High Density) to <br />IIR-IH (Single Family Dwelling District-Low Density) of Lots 1-29 and <br />31-32 of the City View Addition to the City of San Marcos as recorded <br />in Volume 129, Page 363 of the Hays County Deed Records; Lots <br />48-59 of the J.M. Stone Addition to San Marcos, Texas as recorded <br />in Volume 52, Page 438 of the Hays County Deed Records; block 1, <br />Lots 1-12; Block 2, Lots 1-15; Block 3, Lots 1-16 of Dan McKie's <br />First Addition to the City of San Marcos, Hays County, Texas; and, <br /> <br />WHEREAS, subsequent to said public hearing on said date, said <br />Commission did, on December 2, 1986, consider said request <br />and voted to approve the same and has recommended that such request <br />be approved by the City Council of said City; and, <br /> <br />WHEREAS, said City Council held a public hearing on the <br />of February, 1987, regarding such request; and, <br /> <br />23 <br /> <br />day <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, said City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />SECTION 1. That the following described tract of real property <br />located in San Marcos, Hays County, Texas, which is presently <br />"MF-4" (Multi-Family District-High Density) be rezoned HR-l" <br />(Single Family Dwelling District-Low Density): <br /> <br />LOTS 1-29 AND 31-32 OF THE CITY VIEW ADDITION TO THE CITY OF <br />SAN MARCOS AS RECORDED IN VOLUME 129, PAGE 363 OF THE HAYS COUNTY <br />DEED RECORDS; LOTS 48-59 OF THE J. M. STONE ADDITION TO SAN <br />MARCOS, TEXAS AS RECORDED IN VOLUME 52, PAGE 438 OF THE HAYS <br />COUNTY DEED RECORDS; BLOCK 1, LOTS 1-12; BLOCK 2, LOTS 1-15; <br />BLOCK 3, DOTS 1-16 OF DAN MCKIE'S FIRST ADDITION TO SAN MARCOS, <br />TEXAS AS RECORDED IN VOLUME X, PAGE 547 OF THE HAYS COUNTY DEED <br />RECORDS; <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (10) days <br />from and after its passage and after it has been subject to <br />reconsideration by the Council at its next regular meeting following <br />its passage, and providing that the Council did not vote to reconsider <br />it. If recons ide red on March 9, 1987, it sha 11 be in effect ten <br />days from and after its passage on that date if approved. It shall not <br />go into effect if denied.
