()"DINANCE OF THE CITY COUNCI L OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF <br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13,1984 <br />(VOLUME 66) BY CHANGING THE ZONING OF 95.17 ACRES, MORE <br />OR LESS, OF LAND LOCATED ON THE NORTHWEST SIDE OF <br />HUNTER ROAD (FM 2439) BETWEEN LAUREL ESTATES AND WILLOW <br />SPRINGS CREEK, SAN MARCOS, HAYS COUNTY, TEXAS, FROM <br />"PD" (PRE-DEVELOPMENT DISTRICT) AND "R-l" (SINGLE <br />FAMILY DWELLING DISTRICT-LŒv DENSITY) TO "PDD" (PLANNED <br />DEVELOPMENT DISTRICT); APPRO\nNG A PDD DEVELOPMENT PLAN <br />FOR SAID 95.17 ACRE TRACT; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, on November 18, 1986, the Joint Planning and Zoning <br />Commissions of the City of San Marcos held a public hearing regarding a <br />request to change the zoning from "PD" (Pre-development District) and <br />"R-l" (Single Family Dt<lelling District-Low Density) to "PDD" (Planned <br />Development District) of 95.17 acres, more or less, of land located on <br />the northwest side of Hunter Road (FM 2439) between Laurel Estates and <br />willow Springs Creek, said land being located in San Marcos, Hays <br />County, Texas; and, <br /> <br />WHEREAS, subsequent to said public hearing on said date, said <br />Zoning Commission did, on November 18,1986 consider said request and <br />voted to approve the same and has recommended that said request be <br />approved by the City Council of said City; and, <br /> <br />WHEREAS, said City Council held a public hearing on the <br />February, 1987, regarding said request; and, <br /> <br />23 day of <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning Ordinance <br />of the Code of Ordinances of the City of San Marcos pertaining to <br />amendments have been met; and, <br /> <br />WHEREAS, Section 400, Chapter 35, Comprehensive Development Code, <br />of the Code of Ordinances of the City of San Marcos empowers the <br />Planning and Zoning Commissions of the City of San Marcos to recommend <br />approval of a PDD Development Plan; and, <br /> <br />WHEREAS, on November 18,1986, the Zoning Commission of said Citv <br />recommended approval of a PDD Development Plan for said 95.17 acre <br />tract of land located on the northwest side of Hunter Road (FM 2439) <br />between Laurel Estates and willow Springs Creek; and, <br /> <br />WHEREAS, said City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br /> <br />BE <br />TEXAS: <br /> <br />IT <br /> <br />ORDAINED <br /> <br />BY <br /> <br />THE <br /> <br />CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> <br />SECTION 1. That the 95.17 acre tract of land lcoated on the <br />northwest side of Hunter Road (FM 2439) between Laurel Estates and <br />Willow Springs more particularly described by metes and bounds in <br />Exhibit "A", which is attached hereto and incorporated herein for all <br />purposes, which is presently zoned "PD" (Pre-development District) and <br />"R-1" (Single-Family Dwelling District-Low Density) to "PDD" (Planned <br />Development District). <br /> <br />SECTION 2. That the PDD Development Plan for said 95.17 acre <br />tract of land located on the northwest side of Hunter Road (FM 2439) <br />between Laurel Estates and Willow Springs Creek, which is attached <br />hereto and incorporated herein for all purposes as Exhibit "B" is <br />hereby approved. <br /> <br />SECTION 3. That this Ordinance shall be in effect ten (10) days <br />from and after its passage and after it has been subject to <br />reconsideration by the Council at its next regular meeting following <br />its passage, and providing that the Council did not vote to reconsider <br />it. If reconsidered on March 9, 1987, it shall be in effect ten <br />days from and after its passage on that date if approved. It shall not <br />go into effect if denied. If not reconsidered or if reconsidered and <br />approved it shall be published in a newspaper of general circulation in <br />the area as required by the Charter of the City of San Marcos, Texas. <br />
