<br />AN ORDINANC~ ~F THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, M1ENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13,1984 (VOL. 66) BY
<br />ZONING BLOCK 32, LOTS 529 AND 530, WESTOVER ADDITION TO
<br />THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS AS RECORDED IN
<br />VOLUME 59, PAGES 184-185 OF THE HAYS COUNTY DEED RECORDS;
<br />LOCATED IN THE 800 BLOCK OF HILLYER STREET (PORTION NOT
<br />OPENED) FROM IIDP-211 (DUPLEX DISTRICT-MEDIUM DENSITY) TO
<br />"R-l" (SINGLE FAt'\1I LY DWELLING DISTRICT-LOW DENSITY);
<br />AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on January 6, 1987, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "DP-2" (Duplex District-Medium Density) to "R-llI
<br />(Single Family Dwelling District-Low Density) of Block 32, Lot 529
<br />and 530, Westover Addition to the City of San Marcos, Hays County,
<br />Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on January 6, 1987, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />of March, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />HARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "DP-211 (Duplex District-Medium Density) be rezoned IIR-111 (Single
<br />Family Dwelling District-Low Density):
<br />
<br />BLOCK 32, LOTS 529 AND 530, WESTOVER ADDITION TO THE CITY OF SAN
<br />MARCOS, HAYS COUNTY, TEXAS AS RECORDED IN VOLUME 59, PAGES
<br />184-185 OF THE HAYS COUNTY DEED RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on March 23, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.
