<br /> <br /> <br /> <br />17 <br /> <br />ORDINANCE 1987-39 <br /> <br />N<r ORDINANCE OF THE CITY COUNCI L OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY <br />ZONING BLOCK 1, LOTS 1-8 AND 37-44; BLOCK 2, LOTS 9-15 <br />AND 30-36: BLOCK 9, LOTS 55-57 AND 75-78; BLOCK 10; LOTS <br />49,50 AND 81-88 OF THE WESTOVER ADDITION TO THE CITY OF <br />SAN MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME 59, <br />PAGES 184-185 OF THE HAYS COUNTY DEED RECORDS AND BLOCK <br />9, LOT 79A OF THE RESUBDIVISION OF LOTS 79 AND 80 OF THE <br />WESTOVER ADDITION TO THE CITY OF SAN MARCOS, HAYS COUNTY, <br />TEXAS, AS RECORDED IN VOLUME 2, PAGE 143 OF THE HAYS <br />COUNTY PLAT RECORDS; LOCATED GENERALLY IN THE 1400 AND <br />1500 BLOCKS OF FRANKLIN, DEU4AR AND CLYDE STREETS AND THE <br />1300 AND 1400 BLOCKS OF AMHERST AND BAYLOR STREETS <br />FROM "c" (COMMERCIAL DISTRICT); 11M" (SINGLE FAMI LY, <br />DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT AND "DP-2" <br />(DUPLEX DISTRICT-MEDIUM DENSITY) TO "R-l" (SINGLE FAMILY <br />DWELLING DISTRICT-LOW DENSITY); AND DECLARING AN <br />EFFECTI VE DATE. <br /> <br />~'\7HEREAS, on January 6, 1987, the Zoning Commission of the City <br />of San Marcos held a public hearing regarding a request to change <br />the zoning from "C" (Commercial District); "M" (Single Family <br />Duplex and Neighborhood Business District and IIDP-211 (Duplex <br />District-Medium Density) to "MRII (Mobile Home and Residential District) <br />of Block 1, Lots 1-8 and 37-44; Block 2, Lots 9-15 and 30-36; Block 9, <br />Lots 55-57 and 75-78; Block 10, Lots 49,50 and 81-88 of the <br />Westover Addition to the City of San Marcos, Hays County, Texas, <br />and Block 9, Lot 79A of the Resubdivision of Lots 79 and 80 of the <br />Westover Addition to the City of San Marcos, Hays County, Texas; and, <br /> <br />WHEREAS, subsequent to said public hearing on said date, said <br />Commission did, on January 6,1987, consider said request and <br />voted to deny the same and has recommended that such request be <br />changed to "R-111 (Single Family Dwelling District) and as such be <br />approved by the City Council of said City; and, <br /> <br />of <br /> <br />WHEREAS, said City Council held a public hearing on the <br />March, 1987, regarding such request; and, <br /> <br />day <br /> <br />9 <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, said City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />SECTION 1. That the following described tract of real property <br />located in San Marcos, Hays County, Texas, which is presently <br />"c" (Commercial District), "Mil (Single Family, Duplex and Neighborhood <br />Business District and IIDP-2" (Duplex District (Medium Density) be <br />rezoned IIR-l" (Single Family D,^¡elling District-Low Density): <br /> <br />BLOCK 1, LOTS 1-8 AND 37-44; BLOCK 2, LOTS 9-15 AND 30-36; <br />BLOCK 9, LOTS 55-57 AND 75-78; BLOCK 10: LOTS 49,50 AND 81-88 <br />OF THE WESTOVER ADDITION TO THE CITY OF SAN MARCOS, HAYS <br />COUNTY, TEXAS, AS RECORDED IN VOLUME 59, PAGES 184-185 OF THE <br />HAYS COUNTY DEED RECORDS AND BLOCK 9, LOT 79A OF THE <br />RESUBDIVISION OF LOTS 79 AND 80 OF THE WESTOVER ADDITION TO THE <br />CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME <br />2, PAGE 143 OF THE HAYS COUNTY PLAT RECORDS. <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (10) days <br />from and after its passage and after it has been subject to <br />reconsideration by the Council at its next regular meeting following <br />its passage, and providing that the Council did not vote to reconsider <br />it. If reconsidered on March 23, 1987, it shall be in effect ten <br />days from and after its passage on that date if approved. It shall not <br />
