<br />N'I ORDINANCE OF THE CITY COUNCI L OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE ~~ICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING BLOCK 3, LOT 28, WESTOVER ADDITION TO THE CITY OF
<br />SAN MARCOS, HAYS COUNTY, TEXAS AS RECORDED IN VOLUME 59,
<br />PAGES 184-185 OF THE HAYS COUNTY DEED RECORDS; LOCATED AT
<br />THE NORTH CORNER OF THE INTERSECTION OF CLYDE STREET AND
<br />COLOMBIA STREET FROM 11M" (SINGLE, DUPLEX AND NEIGHBORHOOD
<br />BUSINESSES DISTRICT) TO "R-1" SINGLE FAMI LY DWELLING
<br />DISTRICT-LOW DENSITY); AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS,

<br />on January 6, 1987, the Zoning Commission of the City
<br />held a public hearing regarding a request to change
<br />from "M" (Single, Duplex and Neighborhood Business
<br />"R-1" (Single Family Dwelling District-Low Density) of
<br />28, Westover Addition to the City of San Marcos, Hays
<br />and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on January 6, 1987, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City; and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />March, 1987, regarding such request: and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met: and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
<br />
<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "M" (Single, Duplex and Neighborhood Business District) be
<br />rezoned "R-1" (Single Family Dwelling District-Low Density):
<br />
<br />BLOCK 3, LOT 28, WESTOVER ADDITION TO THE CITY OF SAN MARCOS,
<br />HAYS COUNTY, TEXAS AS RECORDED IN VOLUME 59, PAGES 184-185 OF
<br />THE HAYS COUNTY DEED RECORDS;
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on March 23,1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 9 day of March, 1987,
<br />subject to reconsideration at the next regular City Council meeting
<br />sch~duled for March 23, 1987
