<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGU LATES AND RESTRICTS THE LOCATION AND USE OF BUI LDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING BLOCK 32, LOTS 535A AND 536A OF THE RESUBDIVISION
<br />OF BLOCK 32, LOTS 535 AND 536 OF THE WESTOVER ADDITION TO
<br />THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, AS RECORDED
<br />IN VOLUME 4, PAGE 141 OF THE HAYS COUNTY PLAT RECORDS AND
<br />BLOCK 33, LOTS 537-542; BLOCK 43, LOTS 561-566 AND 583-
<br />588; BLOCK 44, LOTS 567-569 OF THE WESTOVER ADDITION TO
<br />THE CITY OF SAN MARCOS, HAYS COUNTY, TEvAS, AS RECORDED
<br />IN VOLUME 59, PAGES 184-185 OF THE HAYS COUNTY DEED
<br />RECORDS; LOCATED ALONG THE 900 AND 1000 BLOCKS OF
<br />HILLYER STREET, THE THE 1000 BLOCK OF ADVANCE STREET AND
<br />THE 900 BLOCK OF HAMILTON STREET FROM "DP-2" (DUPLEX
<br />DISTRICT- MEDIUM DENSITY) TO "R-l (SINGLE FAMI LY DWELLING
<br />DISTRICT -LOW DENSITY); AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on January 6, 1987, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "DP-211 (Duplex District-Medium Density) to "R-ll1
<br />(Single Family Dwelling District-Low Density) of Block 32, Lots 535A
<br />and 536A of the Resubdivision of Block 32, Lots 535 and 536 of the
<br />Westover Addition to the City of San Marcos, Hays County, Texas and
<br />Block 33, Lots 537-542; Block 43, Lots 561-566 and 583-588; Block 44,
<br />Lots 567-569 of the Westover Addition to the City of San Marcos, Hays
<br />County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on January 6, 1987, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City: and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />March, 1987, regarding such request: and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN

<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned IIDP-2" (Duplex District-Medium Density) be rezoned "R-l"
<br />(Single Family Dwelling District-Low Density):
<br />
<br />BLOCK 32, LOTS 535A AND 536A OF THE RESUBDIVISION OF BLOCK 32,
<br />LOTS 535 AND 536 OF THE WESTOVER ADDITION TO THE CITY OF SAN
<br />MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME 4, PAGE 141
<br />OF THE HAYS COUNTY PLAT RECORDS AND BLOCK 33, LOTS 537-542;
<br />BLOCK 43, LOTS 561-566 AND 583- 588; BLOCK 44, LOTS 567-569 OF
<br />THE WESTOVER ADDITION TO THE CITY OF SAN MARCOS, HAYS COUNTY,
<br />TEXAS, AS RECORDED IN VOLUME 59, PAGES 184-185 OF THE
<br />HAYS COUNTY DEED RECORDS;
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on March 23, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 9 day of March, 1987,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for March 23, 1987
