<br /> <br /> <br /> <br />BE <br />TEXAS: <br /> <br />23 <br /> <br />ORDINANCE 1987-44 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ADOPTING THE 1985 EDITION OF THE STANDARD <br />HOUSING CODE IN CHAPTER 14 OF THE SAN MARCOS CODE OF <br />ORDINANCES AND DECLARING AN EFFECTIVE DATE. <br /> <br />IT <br /> <br />ORDAINED <br /> <br />BY <br /> <br />THE <br /> <br />CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> <br />SECTION <br />is repealed. <br /> <br />1. <br /> <br />That Chapter 14 of the San Marcos Code of Ordinances <br /> <br />SECTION 2. That new Chapter 14 of <br />Ordinances is adopted to read as follows: <br /> <br />the <br /> <br />San <br /> <br />Marcos <br /> <br />Code <br /> <br />of <br /> <br />Chapter 14 <br />HOUSING CODE <br /> <br />Sec. 14-1. <br /> <br />Adopted. <br /> <br />There is hereby adopted by the City of San Marcos, Texas, for <br />the purpose of providing the basic minimum housing standards <br />deemed essential for safe and healthful living and the minimum <br />requirements necessary to maintain any residential occupancy in <br />a safe and sanitary condition within the corporate limits of the <br />City of San Marcos, Texas, that certain housing code known as <br />the Standard Housing Code, 1985 Edition, published by the <br />Southern Building Code Congress International Inc., 900 <br />Montclair Road, Birmingham, Alabama 35213, now and as amended, <br />of which a copy has been and now is filed in the office of the <br />city secretary of the City of San Marcos, and incorporated as <br />fully as if set out here. <br /> <br />Sec. 14-2. <br /> <br />Provisions of code to be controlling. <br /> <br />The provisions of the Standard Housing Code shall be <br />controlling within the corporate limits of the City of San <br />Marcos, Texas as to minimum standards required for <br />occupancy of all buildings or portions thereof used, designed or <br />intended to be used, for human habitation regardless of when <br />it may have been constructed. <br /> <br />Sec. 14-3. <br /> <br />Amendments. <br /> <br />The 1985 Edition of the Standard <br />and changed in the following respects. <br /> <br />Housing Code is amended <br /> <br />A. <br /> <br />Section 306.1 shall read as follows: <br /> <br />306.1. <br /> <br />Required space in dwelling unit. <br /> <br />Every dwelling unit shall contain at least four <br />hundred (400) square feet of floor space. The floor <br />area shall be calculated on the basis of the total area <br />of all habitable rooms. <br /> <br />B. <br /> <br />Sections 106.1, 1061.2, 106.2 are repealed. References in <br />Sections 106.3,106.4,106.5, 106.6 and 107 to the Housing <br />Board of Adjustments and appeals are changed to the <br />Building Board of Adjustments and Appeals. <br /> <br />C. <br /> <br />Section 108 is repealed. <br /> <br />D. <br /> <br />New Section 108 is adopted to read as follows: <br /> <br />108. Penalties and Violations. <br /> <br />Any person, firm, corporation or agent who shall <br />violate a provision of this Code or fail to comply with <br />it or any of its requirements shall be guilty of a <br />misdemeanor. Each person, firm, corporation or agent <br />shall be deemed guilty of a separate offense for each <br />and every day or portion of a day during which any <br />violation of any of the provisions of this Code is <br />
