<br />KNOW ALL MEN BY THESE PRESENTS:

<br />THAT WE, ANDREW GARY, JOE B. MILLICAN, Individually and
<br />as Agent and Attorney-in-Fact on behalf of FOY MILLICAN, GEORGE
<br />ALEXANDER, Individually and as Agent and Attorney-in-Fact on be-
<br />half of HAZEL M. ALEXANDER and as Trustee of the HAZEL M.
<br />ALEXANDER GRANDCHILDREN'S TRUST, WILLIAM J. GIBBONS, ALLEN
<br />MCKIMMEY, CHRIS C. SMITH, J. B. ROBERTS, Individually and as
<br />Agent and Attorney-in-Fact on behalf of JOHN B. ROBERTS, STANLEY
<br />AULT, LOLA HORTNESS and DARRELL HORTNESS, hereinafter referred to
<br />as Grantors, for and in consideration for the sum of One Dollar
<br />($1.00) cash to us in hand paid by THE CITY OF SAN MARCOS, TEXAS,
<br />a municipal corporation located in Hays County at 630 East
<br />Hopkins, San Marcos, Texas 78666, and existing by and under the
<br />laws of the State of Texas, hereinafter referred to as Grantee,
<br />the receipt of which is hereby acknowledged, and the further con-
<br />isderation of the benefits to be derived by us on account of the
<br />construction, reconstruction and maintenance by THE CITY OF SAN
<br />MARCOS, TEXAS, of water and wastewater utility lines through a
<br />70.21 acre tract of land owned by Grantors hereinafter described,
<br />do hereby give and grant and convey to THE CITY OF SAN I~RCOS,
<br />TEXAS, a 100 foot wide drainage easement and 20 foot wide public
<br />utility easement for the purpose of providing the relocation of
<br />the drainage of what is known locally as Willow Creek, and
<br />providing runoff and storm drainage along 50 feet each side of
<br />the centerline of said drainage easement, and for the purpose of
<br />construction, reconstruction and perpetually maintaining water
<br />and wastewater utility lines along a 20 foot wide public utility
<br />easement lying entirely within the 100 foot wide drainage
<br />easement, the centerline of said 20 foot wide public utility
<br />easement being parallel to and 40 feet to the west and.north of
<br />the centerline of said 100 foot wide drainage easement,said 100
<br />foot wide drainage easement and said 20 foot wide public utility
<br />easement being out of that certain tract of land conveyed to
<br />Grantors by deed recorded in Volume 365, Page 824-828 of the Hays
<br />County Deed Records, the centerline of said 100 foot drainage
<br />easement being more particularly described by metes and bounds as
<br />follows:
<br />
<br />BEGINNING on the Southwest line of Wonder World Drive, the North-
<br />east line of the Alexander tract, and from which a concrete monu-
<br />ment at the intersection of the Southwest line of the said Wonder
<br />World Drive, with the Southeast line of F. M. Highway No. 2439,
<br />bears N. 45 deg. 44' 42" W., 2323.31 feet (RECORD):
<br />
<br />THENCE, leaving the said Wonder World Drive, with the herein
<br />described centerline, S. 45 deg. 15' 18" W., 1200.00 feet;
<br />
<br />THENCE, N. 89 deg. 44' 42" E. 100.00 feet;
<br />
<br />THENCE, parallel to and 50 feet Northeast of the Southwest line
<br />of the said Alexander tract, N. 45 deg. 57' 09" W., 800.00 feet;
<br />
<br />THENCE, N. 60 deg. 59' 02" W., 211.80 feet, more or less, to the
<br />Southeast line of the said Alexander tract, for the TERMINUS of
<br />the herein described centerline, and from which the aforemen-
<br />tioned concrete monument bears N. 01 deg. 32' 13" E., 1807.34
<br />feet (RECORD), and also from which the West corner of the said
<br />Alexander tract, bears N. 47 deg. 12' 03" W., 700.22 feet, being
<br />100 feet wide and covering 5.31 acres of land, more or less.
<br />
<br />The centerline. of the 20 foot wide utility easement
<br />being parallel to and 40 feet to the west and north of the cen-
<br />terline of the 100 foot drainage easement and parallel to and 10
<br />feet within the most western and northern boundary of said 100
<br />foot easement.
