<br />Þr. h ,b if (J- <br /> <br />THE STATE OF TEXAS <br /> <br />COUNTY <br /> <br />OF <br /> <br />HAYS <br /> <br />EASEMENT <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />THAT BALKHOUSE ASSOCIATES, hereinafter referred to as <br />Grantor, for and in consideration for the sum of One Dollar <br />($1.00) cash to it in hand paid by THE CITY OF SAN MARCOS, TEXAS, <br />a municipal corporation located in Hays County at 630 East <br />Hopkins, San Marcos, Texas 78666, and existing by and under the <br />laws of the State of Texas, hereinafter refer red to as Grantee, <br />the receipt of which is hereby acknowledged, and the further con- <br />isderation of the benefits to be derived by it on account of the <br />construction, reconstruction and maintenance by THE CITY OF SAN <br />MARCOS, TEXAS, of water and wastewater utility lines through a <br />76.52 acre tract of land owned by Grantor herinafter described, <br />do hereby give and grant and convey to THE CITY OF SAN MARCOS, <br />TEXAS, a 100 foot wide drainage easement and 20 foot wide public <br />utility easement for the purpose of providing the relocation of <br />the drainage of what is known locally as Willow Creek, and <br />providing runoff and storm drainage along 50 feet each side of <br />the centerline of said drainage easement, and for the purpose of <br />construction, reconstruction and perpetually maintaining water <br />and wastewater utility lines along a 20 foot wide public utility <br />easement lying entirely within the 100 foot wide drainage <br />easement, the centerline of said 20 foot wide public utility <br />easement being parallel to and 40 feet to the north of the cen- <br />terline of said 100 foot wide drainage easement, said 100 foot <br />wide drainage and said 20 foot wide public utility wasement being <br />out of that certain tract of land conveyed to Grantor by deed re- <br />corded in Volume 374, Page 623, of the Hays County Deed Records, <br />the centerline of said 100 foot drainage easement being more par- <br />ticularly described by metes and bounds as follows: <br /> <br />BEGINNING on the arc of a cu rve to the right on the <br />Southeast line of F. M. Highway No. 2439, same being on the <br />Northwest line of the said 76.52 acre tract, and from which <br />an iron stake found at the North corner of the said 76.52 <br />acre tract, bears, N. 32 deg. 481 E., 166.51 feet; <br /> <br />THENCE, leaving the said F. M. Highway No. 2439, with the <br />herein described centerline, S. 60 deg. 471 E., 690.62 feet <br />to the Eastern Terminus of the herein described centerline, <br />same being on the Northeast line of the said 76.52 acre <br />tract, and from which the aforementioned iron stake found at <br />the North corner of the said 76.52 acre tract, bears N. 47 <br />deg. 031 W., 700.22 feet being 100 feet wide and covering <br />1.59 acres of land; <br /> <br />The centerline of the 20 foot wide utility easement <br />being parallel to and 40 feet to the north of the centerline of <br />the 100 foot drainage easement and parallel to and 10 feet within <br />the northernmost boundary of said 100 foot easement. <br /> <br />This conveyance is made subject to the following: <br /> <br />I. All waterlines and utility lines constructed within the <br />easement area will be confined to the 20 foot public utility <br />easement. <br /> <br />2. The Grantor herein expressly reserves the right to have con- <br />structed a 100 foot wide drainage ditch with 50 foot wide bottom <br />to relocate drainage of what is known locally as Willow Creek <br />along said 76.52 acre tract in accordance with the plans pre- <br />viously approved by the City of San Marcos. <br />
