Þr. h ,b if (J- THE STATE OF TEXAS COUNTY OF HAYS EASEMENT KNOW ALL MEN BY THESE PRESENTS: THAT BALKHOUSE ASSOCIATES, hereinafter referred to as Grantor, for and in consideration for the sum of One Dollar ($1.00) cash to it in hand paid by THE CITY OF SAN MARCOS, TEXAS, a municipal corporation located in Hays County at 630 East Hopkins, San Marcos, Texas 78666, and existing by and under the laws of the State of Texas, hereinafter refer red to as Grantee, the receipt of which is hereby acknowledged, and the further con- isderation of the benefits to be derived by it on account of the construction, reconstruction and maintenance by THE CITY OF SAN MARCOS, TEXAS, of water and wastewater utility lines through a 76.52 acre tract of land owned by Grantor herinafter described, do hereby give and grant and convey to THE CITY OF SAN MARCOS, TEXAS, a 100 foot wide drainage easement and 20 foot wide public utility easement for the purpose of providing the relocation of the drainage of what is known locally as Willow Creek, and providing runoff and storm drainage along 50 feet each side of the centerline of said drainage easement, and for the purpose of construction, reconstruction and perpetually maintaining water and wastewater utility lines along a 20 foot wide public utility easement lying entirely within the 100 foot wide drainage easement, the centerline of said 20 foot wide public utility easement being parallel to and 40 feet to the north of the cen- terline of said 100 foot wide drainage easement, said 100 foot wide drainage and said 20 foot wide public utility wasement being out of that certain tract of land conveyed to Grantor by deed re- corded in Volume 374, Page 623, of the Hays County Deed Records, the centerline of said 100 foot drainage easement being more par- ticularly described by metes and bounds as follows: BEGINNING on the arc of a cu rve to the right on the Southeast line of F. M. Highway No. 2439, same being on the Northwest line of the said 76.52 acre tract, and from which an iron stake found at the North corner of the said 76.52 acre tract, bears, N. 32 deg. 481 E., 166.51 feet; THENCE, leaving the said F. M. Highway No. 2439, with the herein described centerline, S. 60 deg. 471 E., 690.62 feet to the Eastern Terminus of the herein described centerline, same being on the Northeast line of the said 76.52 acre tract, and from which the aforementioned iron stake found at the North corner of the said 76.52 acre tract, bears N. 47 deg. 031 W., 700.22 feet being 100 feet wide and covering 1.59 acres of land; The centerline of the 20 foot wide utility easement being parallel to and 40 feet to the north of the centerline of the 100 foot drainage easement and parallel to and 10 feet within the northernmost boundary of said 100 foot easement. This conveyance is made subject to the following: I. All waterlines and utility lines constructed within the easement area will be confined to the 20 foot public utility easement. 2. The Grantor herein expressly reserves the right to have con- structed a 100 foot wide drainage ditch with 50 foot wide bottom to relocate drainage of what is known locally as Willow Creek along said 76.52 acre tract in accordance with the plans pre- viously approved by the City of San Marcos.
