<br />ORDINANCE NO. 2007- 44 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, ADOPTING A REVISED SAN MARCOS <br />HORIZONS CITY MASTER PLAN SECTOR SIX PLAN AND <br />SECTOR SEVEN PLAN; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. Section 3.1.1.1 of the San Marcos Land Development Code adopts the San Marcos <br />Horizons City Master Plan as the master plan for the physical development of the City, and Section <br />3.1.1.3 of the City Land Development Code provides for the adoption of sector plans as appendices <br />to the San Marcos Horizons City Master Plan. <br /> <br />2. Section 7.02 of the City Charter requires the City Planning and Zoning Commission to <br />"perform an ongoing review of the city's master plan to include... holding public hearings and <br />making recommendations to the city council regarding updates to the land use ... [ element] at least <br />once every three years". <br /> <br />3. The City Council adopted the Sector Six Plan on June 13, 1999. <br /> <br />4. The City Council adopted the Sector Seven Plan on November 15,2001. <br /> <br />5. The Planning and Zoning Commission held a public hearing on a revised Sector Six and <br />Sector Seven Plans on May 8, 2007, and voted on May 22, 2007, to recommend the adoption of a <br />revised Sector Six and a Revised Sector Seven Plan by the City Council. <br /> <br />6. The City Council conducted a public hearing on the adoption of the revised Sector Six and <br />Sector Seven Plans on July 17, 2007. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Sector Six Plan adopted by the City Council on June 13, 1999, is <br />repealed, and the revised Sector Six Plan attached to this ordinance is adopted. <br /> <br />SECTION 2. The Sector Seven Plan adopted by the City Council on November 15,2001, is <br />repealed, and the revised Sector Seven Plan attached to this ordinance is adopted. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />
