<br />Service Contract
<br />Article I - Definitions and Interpretation
<br />
<br />(n) any Change in Law (including the issuance of any Govemmental
<br />Approval, the enactment of any statute, or the promulgation of any regulation) the
<br />terms and conditions of which do not impose more stringent or burdensome
<br />requirements on the Authority than are imposed by the Contract Standards.
<br />"Utilities" means any and all utility services and installations whatsoever
<br />(including gas, electricity, telephone, and telecommunications), and all piping, wiring, conduits,
<br />and other fIxtures of every kind whatsoever related thereto or used in connection therewith.
<br />"Water Treatment System" means the City's potable water treatment system and
<br />the real property on which the structures constituting part of such system are located, as
<br />described in Appendix 1, consisting generally of the Plant, Wells, storage reservoirs, pipes,
<br />mains, valves, and treatment equipment, together with all improvements thereto acquired,
<br />installed, constructed or reconstructed from time to time.
<br />"Wells" means the wells drawing groundwater from the Edwards Aquifer, as
<br />further described in Appendix 1.
<br />"Well Supply Equipment" means the pumps, meter, coIumn, casing, pIpes,
<br />valves, motor control center, electric disconnects, and other well supply equipment.
<br />"Well System SCADA" means the Wells' monitoring and control system.
<br />"Well Water" means all groundwater water pumped from the Wells for
<br />distribution through the water distribution system in the Service Territory in accordance with
<br />Applicable Law.
<br />SECTION 1.2. INTERPRETATION. In this Service Contract notwithstanding
<br />any other provision hereof:
<br />(A) References Hereto. The terms "hereby," "hereof," "hereto," "herein,"
<br />"hereunder" and any similar terms refer to this Service Contract; and the term "hereafter"
<br />means after, and the term "heretofore" means before, the Contract Date.
<br />(B) Gender and Plurality. Words of the masculine gender mean and include
<br />correlative words of the feminine and neuter genders, and words importing the singular
<br />number mean and include the plural number and vice versa.
<br />(C) Persons. Words importing persons include fIrms, companies,
<br />associations, joint ventures, general partnerships, limited partnerships, limited liability
<br />corporations, trusts, business trusts, corporations and other legal entities, including public
<br />bodies, as well as individuals.
<br />(D) Headings. The table of contents and any headings preceding the text of
<br />the Articles, Sections and subsections of this Service Contract shall be solely for convenience of
<br />reference and shall not affect its meaning, construction or effect.
