<br />ARTICLE V <br />PERMITTING RESPONSIBILITIES <br /> <br />SECTION 5.1. AUTHORITY PERMITTING RESPONSIBILITIES. Except as <br />provided in Section 5.2, the Authority shall be responsible (at its own cost, including annual or <br />periodic fees) for applying for, obtaining, providing necessary reports required under, and <br />maintaining in force all Govemment Approvals required for the operation of the Facilities even <br />though such Govemmental Approvals may be in the name of the City, as more fully provided <br />for in Section 6.12. The City shall provide the Authority reasonable assistance and cooperation <br />in the permitting process at its own cost. The Authority shall bear the cost of (including permit <br />fees) and risks (except to the extent a new permit condition constitutes a Change in Law) <br />associated with obtaining, maintaining and complying with such Govemmental Approvals. The <br />Authority shall be responsible for completion of all permit efforts in progress at the time of <br />commencement of this Service Contract. <br />SECTION 5.2. CITY PERMITTING RESPONSIBILITIES. The City shall be <br />responsible for all reporting requirements under the City's Edwards Aquifer Authority permits, <br />and the Authority will fully support the City's reporting requirements by providing any data, <br />reports, test results and other information related to the Facilities which may be necessary for <br />the City to comply with such reporting requirements. The Authority shall not be responsible <br />for obtaining permits or approvals necessary for the implementation of Capital Modifications <br />initiated by the City (unless the parties mutually agree otherwise); provided, however, that the <br />Authority shall provide the City any data, reports, test results and other information and <br />assistance related to the Facilities that may be necessary to obtain such permits and <br />approvals. <br /> <br />SECTION 5.3. OTHER REPORTING REQUIREMENTS. The Authority will <br />fully support the City's reporting requirements for other agencies and entities such as Texas <br />Water Development Board by providing any data, reports, test results and other information <br />related to the Facilities which may be necessary for the City to comply with such reporting <br />requirements or information requests. <br /> <br />31 <br />
