<br />42 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting January 13, 1986 Page 5 <br /> <br /> <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, EXTENDING AND RENEWING THAT FRANCHISE <br />AGREEMENT OF FEBRUARY 20, 1951 BETWEEN SAID CITY AND <br />THE SAN MARCOS TELEPHONE COMPANY FOR A PERIOD OF SIX <br />(6) MONTHS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Craddock moved for approval of the Ordinance on first reading <br />and Mr. Guerra seconded the motion. Mayor Craddock moved to amend <br />the Ordinance to delete the wording "and renewing" from the caption <br />of the Ordinance and from Sections 1 and 2 and Mr. Coddington seconded <br />the motion, which passed unanimously. On roll call for approval of <br />the Ordinance on first reading, the following vote was recorded: <br /> <br />AYE: Coddington, Farr, Craddock, Guerra, Nicola. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Brown. <br /> <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ÞMENDING SECTION.l OF ORDINANCE 1984-70 <br />ADOPTED JUNE 13, 1984 DECLARING A BUILDING MORATORIUM <br />TO DELETE THEREFROM PLANNING UNITS 1,2, 3,4,5, 52 <br />AND 53 EFFECTIVE APRIL 1, 1986; TO DELETE THEREFROM UPON <br />PASSAGE OF THIS ORDINANCE A PORTION OF PLANNING UNITS <br />5 AND 53; AMENDING CHAPTER 29 OF THE CODE OF ORDINANCES <br />OF THE CITY OF SAN MARCOS, TEXAS, BY ADDING AN ARTICLE <br />IX, ENTITLED, "POST ROAD TRAFFIC IMPACT FEE", ESTABLISH- <br />ING A TRAFFIC IMPACT FEE FOR DEVELOPMENT THAT WILL CREATE <br />TRAFFIC DEMAND ON POST ROAD, AND PROVIDING FOR AN EFFECT- <br />IVE DATE. <br /> <br />Mayor Craddock moved for approval of the Ordinance on first reading <br />and Mr. Guerra seconded the motion. Mayor Craddock and Mr. Farr agreed <br />it was inequitable if all were not charged for the use of the road. <br />Mr. Farr stated the fees would not pay for the cost of Post Road im- <br />provements. he would like to see the fee removed and go for bond monies <br />in the future to pay for the needed improvements and use the present <br />bond monies available as soon as possible. Mr. Coddington stated he <br />would prefer developers pay the fee rather than the continuance of the <br />moratorium. Mr. Nicola moved to amend the Ordinance to delete Section <br />3 and Mr. Farr seconded the motion, which passed unanimously. Mr. Brown <br />stated he was in favor of a fee that would be more comprehensive to tax <br />growth for all services. Mr. Gonzalez stated the City is working with <br />the State for a four-lane signalized intersection at Post Road and Aqua- <br />rena and that we needed to acquire right-of-way. It was consensus the <br />City proceed for improvements for two lanes and signalization. The <br />Council then voted unanimously for approval of the Ordinance on first <br />reading. <br /> <br />Mayor Craddock introduced for consideration adoption of two Ordinances <br />on third and final reading by consensus. Mayor Craddock moved for adoption <br />of the two Ordinances on third and final reading by consensus and Mr. <br />Coddington seconded the motion, which passed unanimously.
