Environmental standards pursuant to the following: <br /> <br />(1) Institution of environmental quality control measures tmder the National Environmental Policy Act <br />of 1969, 42 USC ~~4321-4347 and Executive Order 11514 (35 Fed. Reg. 4247), "Protection and <br />Enhancement of Environmental Quality." <br />(2) Notification of violating facilities pursuant to Executive Order 11738 (40 CPR Part 32), "Providing <br />for Administration of the Clean Air Act and the Federal Water Pollution Control Act with Respect to <br />Federal Contracts, Grants, or Loans." <br />(3) Protection of wetlands pursuant to Executive Order 11990, 42 Fed. Reg. 26961. <br />(4) Evaluation of flood hazards in floodplains in accordance with Executive Order 11988, 42 Fed. Reg. <br />26951. <br />(5) Assurance of project consistency with the approved. State Management program developed Wlder the <br />Coastal Zone Management Act of 1972, 16 USC ~~1451 et seq., as amended. <br />(6) Conformity of federal actions to state clean air implementation plans under the Clean Air Act of <br />1955, as amended, 42 USC ~97401 et seq. <br />(7) Protection of underground sources of drinking water under the Safe Drinking Water Act of 1974,42 <br />USC ~~300f-300j, as amended. <br />(8) Protection of endangered species under the Endangered Species Act of 1973, 16 USC 9~ 1531 et <br />seq., as amended. <br /> <br />K. The Hatch Political Activity Act, 5 USC 997321.26, which limits the political activity of employees whose <br />principal employment activities are funded in whole or in part with federal funds. <br /> <br />L. The Fair Labor Standards Act, 29USC ~~201 etseq., and the Intergovernmental Personnel Act of 1970, 42 <br />USC ~~4701 et seq., as applicable, concerning minimum wage and maximum hours. <br /> <br />M. Texas Occupations Code, Chapter 170 I, as amended, and all rules adopted by the Texas Commission on <br />Law Enforcement Officer Standards and Education pursuant to Chapter 1701, as amended, relating to <br />regulated law enforcement agencies. <br /> <br />PERFORMING AGENCY shall ensure that the facilities under its ownership, lease or supervision which will be <br />utilized in the accomplishment of the project are not listed on the Environmental Protection Agency's (EP A) list of <br />Violating Facilities and shall notify the Federal grantor agency of the receipt of any communication from the Director <br />of the EP A Office of Federal Activities indicating that a facility to be used in the project is under consideration for <br />listing by the EP A (Executive Order 11738). <br /> <br />PERFORMING AGENCY shall comply with the flood insurance purchase requirements of 102(a) of the Flood <br />Disaster Protection Act of1973. 42 use ~~OO 1-4003, as amended.
