<br /> 160 \~ <br /> - <br /> RESOLUTION 1997- 66 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, RESCINDING THE RESOLUTION ADOPTED ON <br />FEBRUARY 24, 1997 IN WHICH THE TERMS AND CONDITIONS OF AN <br />AGREEMENT BETWEEN THE CITY AND THE CITY OF KYLE FOR <br />WATER SUPPLY TO CHAMPIONS BUSINESS PARK WERE APPROVED; <br />APPROVING THE TERMS AND CONDITIONS OF A REVISED <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. On February 24, 1997 the City approved the terms and conditions of an <br />interlocal agreement between the City and the City of Kyle for water supply to Champions <br />Business Park. <br />2. The City of Kyle asked for revisions to the agreement subsequent to its <br />approval by City Council . <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> .. <br />PART 1. The resolution adopted on February 24, 1997 in which the terms and <br />conditions of an interlocal agreement between the City and the City of Kyle for water <br />supply to Champions Business Park were approved is rescinded. <br />PART 2. The interlocal agreement approved on February 24, 1997 is declared <br />null and void. <br />PART 3. The terms and conditions of a revised interlocal agreement for water <br />supply to Champions Business Park which is atta,ched to this Resolution are approved. <br />PART 4. The City Manager, Larry D. Gilley, is authorized to execute this <br />agreement on behalf of the City. <br />PART 5.
