- l/P/A 6. Cooperation in Other Matters. The parties agree to cooperate regarding the following: A. Compliance with regulatory requirements of any governmental agency having jurisdiction over this agreement. B. The development of alternatives to the use of Edwards Aquifer water for water - supply purposes. I C. The installation of one or more interconnections between the supply lines of the parties that in proximity to each other, and in particular those lines existing or planned along Yarrington Road on the East side of HI-35. The parties anticipate that (a) at least one interconnect of 12" or more in diameter shall be made coincident with the completion of San Marcos' surface water supply project (the "Project"), (b) this interconnection will enable the Project to provide a supply of potable water to Kyle, and (c) the Project will be capable of treating and delivering to Kyle, at such interconnect, 1,000,000 gallons per day of potable water. The fITst interconnection and all subsequent interconnections will be covered by separate written agreements between the parties. 7. Miscellaneous. . A. This agreement is severable, and if any provision of this agreement is detennined to be invalid by a court or regulatory agency of competent jurisdicion, the remainder of this agreement will remain in effect. D. Each party represents that its governing body has approved this agreement.
