<br />I <br /> <br />located in the South Texas Division and Exhibit B for those ACM Cities located in the <br />BeaumontlEast Texas Division. <br /> <br />2. CenterPoint and the ACM Cities agree not to implement new natural gas rates for <br />the ACM Cities earlier than three (3) years from the effective date of the gas rates <br />established by this Settlement Agreement. The effective date of the gas rates established <br />by this Settlement Agreement will be the later of May 1, 2006, or the first day of the <br />month following the repeal of the ordinances identified in paragraph 13 of this Settlement <br />Agreement by all of the ACM Cities. <br /> <br />3. CenterPoint agrees that for a three (3) year period beginning on the effective date <br />of the gas rates established by this Settlement Agreement, CenterPoint will not file with <br />the ACM Cities a request for interim cost recovery and rate adjusbnent pursuant to TEx. <br />UTIL. CODE ~ 1 04.30 1 (Vemon Supp. 2005). <br /> <br />4. The ACM Cities and CentcrPoint agree to adopt the depreciation rates approved <br />by the Commission in GOO No. 9533 and GOO No. 9534. The agreed upon depreciation <br />rates are set forth in Exhibit C to this Settlement Agreement. <br /> <br />I <br /> <br />5. CenterPoint agrees that, within its BeaumontlEast Texas Division as that division <br />is constituted as of June 30, 2005, and for a three (3) year period beginning on the <br />effective date of the gas rates established by this Settlement Agreement, if it charges any <br />customer class within its BeaumontlEast TexaS Division, a lower rate or rates for any of <br />its services than it charges the same customer class in the ACM Cities, the lower rate or <br />rates for any of its services will additionally accrue to the affected customer class in the <br />ACM Cities effective with the next billing cycle immediately following implementation <br />of the lower rate or rates; provided, however, that the provisions of this paragraph shall <br />not apply to a lower rate or rates resulting from an inquiry by a non-ACM City pursuant <br />to such city's regulatory authority under the Gas Utility Regulatory Act or any <br />subsequent appeal to the Railroad Commission of such municipal action. <br /> <br />6. CenterPoint agrees that, within its South Texas Division, as that division is <br />constituted as of June 30, 2005, and for a three (3) year period beginning on the effective <br />date of the gas rates established by this Settlement Agreement, if it charges any customer <br />class within its South Texas Division, a lower rate or rates for any of its services than it <br />charges the same customer class in the ACM Cities, the lower rate or rates for any of its <br />services will additionally accrue to the affected customer class in the ACM Cities <br />effective with the next billing cycle immediately following implementation of the lower <br />rate or rates; provided, however, that the provisions of this paragraph shall not apply to a <br />lower rate or rates resulting from an inquiry by a non-ACM City pursuant to such city's <br />regulatory authority under the Gas Utility Regulatory Act or any subsequent appeal to the <br />Railroad Commission of such municipal action. <br /> <br />I <br /> <br />7. CenterPoint agrees that any future public notice related to a Statement of Intent to <br />Change Rates filed with the ACM Cities .will be published in the official newspaper of <br />each ACM city affected by the Statement of Intent, which list of newspapers is attached <br />to this Settlement Agreement as Exhibit D, and will contain the information set forth <br />below: <br /> <br />2 <br />
