<br />I <br /> <br />Sec. 26.031. Desianation of certain authorized emeraency vehicles. <br /> <br />The followino vehicles are desiqnated authorized emerqenCV vehicles for the <br />purposes set forth, reoardless of whether a disaster exists: <br /> <br />(a) Director of public health vehicle while respondino to a medical emeroency. <br /> <br />(b) Gas division emeroencv unit vehicles while respondino to a oas emeroency. <br />which may threaten life or property. <br /> <br />(c) Electric utilitv emeroency unit while respondinq to a electric utilitv emeroency, <br />which may threaten life or property. <br /> <br />(d) Director of safety and risk manaoement vehicle while respondino to an <br />emeroency call or emeroency situation. <br /> <br />(e) Office of emeroencv manaqement vehicle while respondino to an emerqency <br />call or emeroency situation. <br /> <br />I <br /> <br />(f) Buses and other vehicles owned and operated bv Ithe city, reoional <br />transportation authority, school districts. and other public or private entities while <br />beino used in an emeroencv evacuation prooram directed by the city manaoer, <br />includinq while returnino residents to the city from shelters. <br /> <br />Section 2: If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent <br />jurisdiction, the other provisions of this ordinance will continue in force if they can <br />be given effect without the invalid portion. <br /> <br />Section 3: All ordinances and resolutions or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />Section 4: Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San <br />Marcos City Code upon conviction. <br /> <br />Section 5: This Ordinance will take effect ten days after the date of its final <br />passage, and the City Clerk will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br /> <br />I <br /> <br />PASSED on first reading on <br /> <br />June 6, 2006. <br /> <br />PASSED second reading on <br /> <br />June 22, 2006. <br /> <br />13 <br />
