<br />I <br /> <br />I <br /> <br />I <br /> <br />SECTION 7. Open Meetings Compliance. It is hereby found, determined and declared that <br />a sufficient written notice of the date, hour, place and subject of the meeting ofthe City Council at <br />which this Ordinance was adopted was posted at a place convenient and readily accessible at all <br />times to the general public at the City Hall of the City for the time required by law preceding its <br />meeting, as required by the Open Meetings Law, Texas Government Code, ch. 551, and that this <br />meeting has been open to the public as required by law at all times during which this Ordinance and <br />the subject matter hereof has been discussed, considered and formally acted upon. The City Council <br />further ratifies, approves and confirms such written notice and the contents and posting thereof. <br /> <br />SECTION 8. The contents ofthe notice of the public hearing held before the City Council <br />on February 21, 2006, and the publication of the notice, are ratified and confirmed. <br /> <br />SECTION 9. The Preliminary Project Plan and Reinvestment Zone Financing Plan for the <br />Zone, a copy of which is attached as Exhibit C, are approved. <br /> <br />SECTION 10. Without limiting the authority of the City Council to terminate the Zone for <br />good and sufficient reason, the City Council expressly reserves the right to terminate the Zone for <br />failure or inability of Hays County to commit, by agreement with the City, a sufficient portion of the <br />tax increment revenue of Hays County from the Zone towards the costs of the Project. <br /> <br />SECTION 11. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force ifthey can be given effect without the invalid portion. All references <br />to state laws in this ordinance are intended to refer to those laws as they may be amended from time <br />to time. <br /> <br />SECTION 12. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 13. This Ordinance will take effect ten days after the date of its final passage, <br />and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the <br />City. <br /> <br />PASSED on first reading on February 21, 2006. <br /> <br />PASSED on second reading on March 7, 2006. <br /> <br />PASSED, APPROVED AND ADOPTED on March 21, 2006. <br /> <br />~z~ <br /> <br />Mayor <br /> <br />-5- <br />
