<br />I <br /> <br />ORDINANCE NO. 2006-54 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS INCREASING THE MONTHLY <br />RATE FOR RECYCLING CENTER SERVICES; <br />INCLUDING PROCEDURAL PROVISIONS; AND <br />DECLARING AN EMERGENCY. <br /> <br />RECITALS: <br /> <br />1. The City Council approved a contract with Green Guy Recycling Services ("Green <br />Guy") for the operation of a recycling center and related services on May 12,2003. <br /> <br />2. Green Guy has requested an increase of 6.46% to its rate based on increases in <br />operation due to higher costs for fuel, equipment and supplies and labor. The approval of this <br />request necessitates an increase in the rate charged to customers for recycling center services. <br /> <br />3. The approval of this ordinance will increase the monthly rate for recycling center <br />services from $0.52 to $0.55 for a monthly increase of $.03. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />I <br /> <br />SECTION 1. Under Section 66.028 of the San Marcos City Code, the monthly charge <br />for recycling center services available to each residential unit located in the City is set at $.55. <br /> <br />SECTION 2. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 4. The importance of this Ordinance creates an emergency and an imperative <br />public necessity, and the provisions of the Charter requiring that ordinances be presented at three <br />separate meetings, and that ordinances do not take effect until ten days after the date of its final <br />passage are suspended, and this Ordinance will take effect upon publication of notice of its <br />adoption in a newspaper of general circulation within the City, and will apply to all billings <br />issued on and after November 1, 2006. <br /> <br />PASSED, APPROVED AND ADOPTED on October 17,2006. <br /> <br />I <br /> <br />. <br /> <br /> <br />~z~ <br /> <br />Mayor <br />
