POLE SIGNS. d. to read as follows: <br /> "any portion of such SIGN which overhangs an open area shall maintain <br /> a free clearance of at least 9 feet and at least 12 feet when over- <br /> hanging a vehicular drive; 11 and Mayor Craddock seconded the motion, <br /> which passed unanimously. Mr. Coddington moved to amend the Ordinance <br /> as follows: ARTICLE II. DEFINITIONS. Alphabetized; defined words <br /> placed in capital letters; ARTICLE II. 1. ABANDONED SIGN. To include <br /> off-premise signs; Section 3-3. Abandonment. To include off-premise <br /> signs; Section 4-1. Titles 4-1.3. New off-premise signs; Titles 4-1.3.a. <br /> With existing structures; Titles 4.1.3.b. Smaller signs; Titles 4-1.3.c. <br /> Larger signs; Titles 4-1.4. Zoning Districts and land use categories; <br /> Section 4-2. Safety aspects of portable signs returned; Section 4-5. <br /> Variances section moved to Section 5-5; Section 5-5. Variances added. <br /> Titled Appeal and Variances. Rewording for two subsections; and Mr. <br /> Nicola seconded the motion, which passed unanimously. Ms. Kissler <br /> moved to amend Section 4-1.1. Restructuring. to read as follows: "Exist- <br /> ing OFF-PREMISE SIGNS may be restructured from multiple wooden pole <br /> frames to metal mono pole frames so long as the SIGN FACE of thè new <br /> structure is no larger than the existing SIGN FACE or 480 square feet, <br /> whichever is smaller; and the height of such restructured SIGN shall <br /> be in compliance with height limitations set out in Subsection 3. be- <br /> low, " and Mr. Guerra seconded the motion, which passed unanimously. <br /> Ms. Kissler moved to amend the Ordinance on Page 10, Section 4-1.3.c. <br /> to read as follows: IILarger SIGNS. SIGNS greater than 75 square feet <br /> but not exceeding 260 square feet along IH35 in area shall have a height <br /> not exceeding 42.5 feet above the crown of the nearest highway other <br /> than service or access roads, . . .11, and Mr. Nicola seconded the mo- <br /> tion. On roll call the following vote was recorded: <br /> AYE: Brown, Kissler, Nicola. <br /> NAY: Coddington, Farr, Craddock, Guerra. <br /> ABSTAIN: None. <br /> The motion failed. Mayor Craddock moved to amend Pagffi 9 and 10 in <br /> Section 4-1. to change off-PREMISE SIGN to OFF-PREMISE SIGN wherever <br /> it appears; change replacement to relocation and relocated; rename <br /> 4-1. 3. RESTRUCTURED AND RELOCATED OFF-PREMISE SIGNS; change the word- <br /> ing new OFF-PREMISE SIGNS to RESTRUCTURED AND RELOCATED OFF-PREMISE <br /> SIGNS wherever it appears; indent Subsection c. Larger SIGNS.; in <br /> Subsection 5. EXISTING SIGNS: to read as follows: 11 At the <br /> . . . <br /> time of registration, the operator or OWNER of a nonconforming OFF- <br /> PREMISE ADVERTISING SIGN shall pay a one time inspection fee of $20.00. <br /> Failure to register a NONCONFORMING OFF-PREMISE SIGN, or failure to pay <br /> the annual inspection fee, " and Mr. Nicola seconded the motion, <br /> . . . . , <br /> which passed unanimously. The Council directed wording be provided at <br /> third reading for a new subsection under Section 4-1.3. to bele.ttered <br /> d.
