On the 116th business day after supplemental information for the <br />application has been received in response to a notice that the application is <br />incomplete, if the responsible official applieant has not provided notice <br />otherwise been notified that the application, including the supplemental <br />information, is incomplete. <br /> <br />(4) If an the application is not complete, the responsible official shall provide a <br />written notice to the applicant specifying the documents or other information <br />needed to complete the application, and stating the date the application will <br />expire if the supplemental information is not provided it will be returned to the <br />applicant together \\1.th any accompanying subordinate applications. +he <br />responsible official may retain an application without acccpting it for filing if the <br />official determines that minor supplementation by the applicant v.ill result in a <br />complete application. The official v/ill inform the applicant of the need for <br />supplementation, and if the applicant does not pro'/ide the supplemental <br />information \\ithin five (5) \vorking days, the official will return the application <br />to the applicant together vlith any accompanying subordinate applications. <br /> <br />(5) If the responsible official determines that an application (including supplemental <br />information received in response to a notice that the application is incomplete) is <br />not complete on or before the 45th day after the application is submitted, the <br />application will be deemed to have expired on that 45th day, and it will be <br />returned to the applicant together with any accompanying documents. Thereafter, <br />the applicant must submit a new application. The City may retain any fee paid for <br />reviewing the application for completeness. <br /> <br />(d) Waiver. Notwithstanding the requirements of subsection (h a) of this section, the <br />responsible official may initially waive a technical requirement relating to the form or <br />content of an application if it appears unnecessary the submission of any information in <br />the application and accompanying materials that is not necessary due to the scope and <br />nature of the proposed activity. The decision maker on the application may withdraw the <br />a-waiver, however, of application requirements if the decision maker determines that <br />meeting the pre'/iously v.'uived requirements is necessary to determin~ffig compliance <br />with applicable standards of approval. <br /> <br />(e) Commencement ofCitv Review Period Ofjicial Filing Date. The time period established <br />by state law or this Land Development Code for processing or deciding an application <br />shall commence on the date that an complete application is deemed to be complete under <br />subdivision (c)(3) ofthis section has been accepted for filing, which date shall be deemed <br />the official filing date. <br /> <br />(f) Pre-Application Conference. An applicant is encouraged to request a pre-application <br />conference with the responsible official prior to filing submittal of an application fef <br />:filing.
