ORDINANCE NO. 2005- 87 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY AN AREA CONSISTING OF 232 86 ACRES, MORE OR LESS, LOCATED IN THE 1500 - 3100 BLOCKS OF HIGHWAY 123 (BALCONES BUSINESS PARK TRACT), APPROVING A SERVICE PLAN FOR THIS AREA, AND INCLUDING PROCEDURAL PROVISIONS RECITALS: 1 The CIty CouncIl of the CIty of San Marcos, Texas, provIded an OpportunIty for all mterested persons to be heard at two publIc heanngs, held OfBeptember 20, 2005 and on September 27 , 2005, to consIder the proposed annexatIon by the CIty of 204.57 acres, more or less, located m the 1500-3100 blocks of Highway 123, m Hays County, Texas (the II AnnexatIOn Area"), conslstmg of all of the followmg tracts of property' I F A. The 4 41 acre, more or less, tract of land described by metes and bounds m the attached ExhibIt A. The 2 97 acre, more or less, tract of land described by metes and bounds m the attached ExhibIt B The 22 62 acre, more or less, tract of land described by metes and bounds m the attached ExhibIt C The 59 70 acre, more or less, tract of land described by metes and bounds m the attached ExhibIt D The 113 79 acre, more or less, tract of land conslstmg of the 166 670 acre, more or less, tract of land described by metes and bounds m the attached ExhibIt E-l less and except the 52.88 acre more or less, tract of land descnbed by metes and bounds m the attached ExhibIt E-2 acres preVIOusly annexed as shown m the attached ExhibIt E-3 (CIty Ordmance 1980-50) The 29 370 acre, more or less, tract of land described by metes and bounds m the attached ExhibIt F B C D E 2 The CIty has receIved petItIons for annexatIOn from the owner(s) of the property mcluded m the AnnexatIOn Area, except that tract described m ExhibIt F, copIes of WhICh are attached as ExhibIts G-I and G-2. 3 The tract described m ExhibIt F conSIsts of portIOns the eXlstmg nght-of-way of State Highway No 123, Farm to Market Road No 3407 and ClOVIS Barker Road. ThIS tract IS mcluded m the AnnexatIOn Area at the request of the Fire ChIef m order to address publIc safety concerns.
