<br />councIl wIll set the compensatIOn of the presldmg ludge and aSSOCiate ludges, and m <br />domg so, the councIl shall consIder the CIty manager's annual evaluatIOn of munIcIpal <br />court operatIOns. <br /> <br />I <br /> <br />(c) The mUnIcIpal court clerk shall operate under the supervlSlon of the CIty manager. The <br />mUnIcIpal court clerk shall perform all dutIes of a court clerk as provIded under state law <br />and the CIty charter, and shall perform the followmg: <br /> <br />(1) EstablIshmg and revlsmg procedures related to the admmlstratIOn of the <br />mUnICIPal court, mcludmg procedures for the collectIOn of fines, fees, costs and bonds, <br /> <br />(2) SchedulIng tnal dockets and, If necessary, arraignment dockets, on days and <br />tlmes and WIth suffiCIent frequency to ensure the prompt dlsPosltlon of cases before the <br />court; <br /> <br />(3) Prepanng and submlttmg a report each month to the CIty manager and the <br />presldmg ludge showmg the style, number and dISpOSItIOn of each case dIsposed of In the <br />court dunng the precedmg month, and also showmg the amount of fine assessed In each <br />case, and how the fine was satIsfied, whether by payment, by commUnIty serVIce, or by <br />other means, <br /> <br />(4) Formulatmg proposed budgets for the mUnICIpal court WIth Input from the I <br />presldmg ludge, <br /> <br />(5) Prepanng and mamtammg complete and accurate dockets and mmutes <br />reflectmg the status and dISPOSItIon of all cases m the mUnICIPal court; <br /> <br />(6) Havmg custody of all records related to the busmess of the mUnICIPal comi, <br />mcludmg electronIc records, and <br /> <br />(7) Preservmg the records of the mUnICIPal court, IncludIng electrOnIC records, m <br />accordance WIth the CIty records retentIOn schedule. <br /> <br />SECTION 2 If any word, phrase, clause, sentence, or paragraph of thIS ordInance IS held <br />to be unconstItutIOnal or mvalId by a court of competent JurisdIctIOn, the other proVISIOns of thIS <br />ordInance WIll contInue m force If they can be gIven effect WIthout the mvalId portIOn. <br /> <br />SECTION 3 All ordmances and resolutIOn or parts of ordmances or resolutIOns m <br />conflIct WIth thIS ordInance are repealed. <br /> <br />SECTION 4 ThIS Ordmance wIll take effect 10 days after the date of ItS final passage, <br />and the CIty Clerk WIll publIsh notIce of ItS adoptIOn m a newspaper of general cIrCUlatIOn m the <br />CIty <br /> <br />I <br /> <br />PASSED AND APPROVED on first readmg on January 4, 2004 <br /> <br />2 <br />
