HOOVER, AND TO BETTY JACK RAINS AND DON RAINS, AUTHORIZING THE CITY MANAGER TO EXECUTE DEEDS, AND INCLUDING PROCEDURAL PROVISIONS RECITALS 1 On September 7, 2005, Ida F Miller and Nicholas L. Hoover submItted an applIcatIOn to abandon the alley approXImately 40 feet by 85 feet m SIze adjacent to the 800 Block of LeWIS Street, as depIcted on the attached ExhibIt A. 2 The applIcatIOn was accompanIed by the wntten consent to the abandonment by all owners of property adJ acent to the alley, and by the wntten consent to the conveyance of portIOns of the alley to Ida F Miller and Nicholas L. Hoover, and to Betty Jack Rams and Don Rams. I 3 On October 11,2005, the CIty Planmng and Zonmg CommISSIOn conducted a publIc hearmg on the request, and voted unanImously to recommend approval of the request. 4 The CIty CouncIl conducted a publIc hearmg regardmg thIS abandonment on November 1 ,2005 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS SECTION 1 The abandonment of the alley approxImately 395 feet by 85 feet m SIze adjacent to the 800 Block of LeWIS Street, as depIcted on the attached ExhibIt A, IS approved. SECTION 2 The CIty Manager Dan O'Leary, IS authonzed to execute QmtclaIm Deeds wIthout cash conSIderation to convey portIOns of the alley to Ida F Miller and Nicholas L Hoover, and to Betty Jack Rams and Don Rams, upon completIOn of a survey of the respectIve tracts to be deeded to them m accordance WIth then agreement as described m the abandonment applIcatIOn. SECTION 3 ThIS Ordmance wIll take effect 10 days after the date of ItS final passage, and the CIty Clerk wIll publIsh notIce of ItS adoptIOn m a newspaper of general cnculatIOn m the CIty PASSED AND APPROVED on first readmg November 1, 2005.
