The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to establish the zoning for the following real property as "C" Commercial District: Street address: 2900 Block ofIH-35 North. Size: 50.919 acres. Legal description: See the metes and bounds description attached as Exhibit B. Deed or plat reference: Volume 720, Page 152, Real Property Records. SECTION 3. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to establish the zoning for the following real property as "LI" Light-Industrial: Street address: 2900 Block ofIH-35 North. Size: 38.718 acres. Legal description: See the metes and bounds description attached as Exhibit C. Deed or plat reference: Volume 720, Page 152, Real Property Records. SECTION 4. The future land use map of City, included in the Horizons City Master Plan adopted in City Code Section 102.026, is amended to conform to the zoning designations described in Sections 1,2 and 3 of this ordinance. SECTION 5. Any person violating any proVISIOn of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 6. After its onginal passage. this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice. PASSED, APPROVED AND ADOPTED on September 13 , 2004, subject to reconsideration at the next regular City Council meeting scheduled for September 27. 2004. I I I
