<br />Chapter 1 Development Procedures - Article 5 Zoning Procedures <br /> <br />(3) Final Subdivision Plat that includes the lot for which the Conditional Use <br />Permit is sought. <br /> <br />(b) Accompanying Applications. An application for a Conditional Use Permit shall be <br />accompanied by a Site Plan and may be accompanied by an application for a Site <br />Preparation Permit, provided that the application for the Conditional Use Permit is <br />first decided. <br /> <br />Section 1.5.7.3 <br /> <br />Application Requirements <br /> <br />(a) Responsible Official. The Planning Director shall be the responsible official for a <br />Conditional Use Permit. <br /> <br />(b) Contents. An application for approval of a Conditional Use Permit shall be prepared <br />in accordance with Chapter I of the Technical Manual. <br /> <br />Section 1.5.7.4 <br /> <br />Processing of Application and Decision <br /> <br />(a) Hearing and Notification. The Director shall schedule a public hearing before the <br />Planning and Zoning Commission on the application for a Conditional Use Permit, <br />and shall cause personal notice to be given in accordance with Article 3, Division 2 of <br />this Chapter I. <br /> <br />(b) Commission Decision. The Planning and Zoning Commission shall conduct a public <br />hearing on the application in accordance with Article 3, Division 3 of this Chapter I. <br />The Planning and Zoning Commission shall be the initial decision maker, subject to <br />appeal to the City Council, on whether to approve, approve with conditions or <br />modifications, or deny the permit. The Planning and Zoning Commission may also <br />recommend whether any requested variations from the standards in the zoning district <br />regulations should be granted by the Zoning Board of Adjustments. <br /> <br />Section 1.5.7.5 <br /> <br />Criteria for Approval <br /> <br />(a) Factors. When considering an application for a Conditional Use Permit, the Planning <br />and Zoning Commission shall evaluate the impact of the proposed conditional use on <br />and its compatibility with surrounding properties and residential areas to ensure the <br />appropriateness of the use at the particular location, and shall consider the extent to <br />which: <br /> <br />(1) The proposed use at the specified location is consistent with the policies <br />embodied in the adopted Master Plan; <br /> <br />City of San Marcos, Texas <br /> <br />1-72 <br /> <br />Land Development Code - Final <br /> <br />It <br /> <br />It <br /> <br />, <br />
