<br />Chapter 1 Development Procedures - Article 5' Zoning Procedures <br /> <br />(a) Responsible Official. The Planning Director shall be the responsible official for a <br />Cluster Development Plan. <br /> <br />(b) Contents. An application for approval of a Cluster Development Plan shall be <br />prepared in accordance with Chapter 1 of the Technical Manual. <br /> <br />Section 1.5.8.4 <br /> <br />Processing of Application and Decision <br /> <br />(a) Hearing and Notification. The Director shall schedule a public hearing before the <br />Planning and Zoning Commission on the application for approval of a Cluster <br />Development Plan. The notice posting may be combined with that for a Watershed <br />Protection Plan (Qualified, where applicable) for the same land. <br /> <br />(b) Commission's Action. The Planning and Zoning Commission shall conduct a public <br />hearing on the application in accordance with Article 3, Division 3 of this Chapter I. <br />The Commission shall approve, conditionally approve or deny the application for a <br />Cluster Development Plan. <br /> <br />Section 1.5.8.5 <br /> <br />Criteria for Approval <br /> <br />(a) Factors. The Planning and Zoning Commission, or the City Council on appeal, shall <br />apply the following factors in taking action on the Cluster Development Plan <br />application: <br /> <br />(1) The Cluster Development Plan meets the standards for residential density or <br />lot coverage as outlined in Table 4.1.6.1 in Chapter 4, Article 2, Division I, <br />subject to any limitations contained within Chapter 5. <br /> <br />(2) The Cluster Development Plan is consistent with other zoning district <br />regulations, including any approved Concept Plan in a planned development <br />(PD) district. <br /> <br />(3) The Cluster Development Plan conforms to the approved Watershed <br />Protection Plan (Phase 1); <br /> <br />(4) The Cluster Development Plan meets the residential compatibility standards in <br />Chapter 6, Article I, Division 4. <br /> <br />(5) The Cluster Development Plan contains sufficient buffering to assure <br />compatibility with adjacent uses and the character of the neighborhood. <br /> <br />(b) Conditions.
