<br />, <br /> <br />41 <br /> <br />J <br /> <br />Chapter 1 Development Procedures - Article 5 Zoning Procedures <br /> <br />Section 1.5.9.5 <br /> <br />Criteria for Approval <br /> <br />(a) Criteria. In deciding whether to approve, conditionally approve or deny the <br />application for a special exception, the ZBOA shall apply the standards in Chapter 4, <br />Article 5, Division 3 governing the special exception. In addition, the ZBOA shall <br />consider whether the special exception will substantially and adversely affect the use <br />of adjacent or neighboring property. <br /> <br />(b) Conditions. The ZBOA may impose such conditions on the application for special <br />exception as are necessary to prevent harm to adjacent or neighboring property. <br /> <br />Section 1.5.9.6 <br /> <br />Expiration <br /> <br />(a) The special exception shall expire one year after the ZBOA approves or conditionally <br />approves the application unless the applicant obtains all necessary construction <br />permits or otherwise performs the tasks authorized by the approved special exception <br />within such period. <br /> <br />City of San Marcos, Texas <br /> <br />Land Development Code - Final <br /> <br />1-79 <br />
