<br />t <br /> <br />t <br /> <br />I <br /> <br />Chapter 1 Development Procedures - Article 6 Platting Procedures <br /> <br />(e) Time for Decision. The decision on approval or denial of construction plans shall be <br />made within 30 working days of the official filing date. <br /> <br />(f) Revised Plan Submission. If the conditions of approval require revision(s) to the <br />construction plans, one set shall be marked with objections noted (on the plans <br />themselves and/or in memo format) and returned to the applicant for correction, <br />whereupon the applicant's engineer shall correct the plans as requested and resubmit <br />them for decision. A properly revised set of construction plans shall be submitted to <br />the Engineering Director within 10 working days of receipt of the notice of decision. <br />The Director shall have an additional 20 working days to approve or deny the revised <br />set of plans. <br /> <br />(g) Appeal. Where construction plans are submitted after approval of a Preliminary <br />Subdivision Plat or Preliminary Development Plat, the Engineering Director's <br />decision on the plans may be appealed to the Planning and Zoning Commission in <br />accordance with Article 10, Division 2, and shall be decided in conjunction with the <br />Commission's decision on the Final Subdivision Plat or Final Development Plat <br />application. An appeal of the Director's decision must be accompanied by a Final <br />Subdivision Plat or Final Development Plat application, and the grounds for appeal <br />shall be certified and documented by a professional engineer licensed in the State of <br />Texas. <br /> <br />(h) Criteria for Approval. The Engineering Director or the Commission on appeal shall <br />render a decision on the construction plans in accordance with the following criteria: <br /> <br />(1) The plans are consistent with the approved Preliminary Subdivision Plat or <br />approved Preliminary Development Plat, or the proposed final Subdivision <br />Plat or proposed Final Development Plat; <br /> <br />(2) The plans conform to the approved Watershed Protection Plan (Phase 2) and <br />Site Preparation Permit; <br /> <br />(3) The plans conform to the environmental standards, development standards, <br />and standards for adequate public facilities contained in chapters 5, 6, and 7 of <br />this Land Development Code; and <br /> <br />(4) The plans conform to the specifications contained in the City's TCSS. <br /> <br />(i) Effect. Approval of construction plans authorizes the property owner to install public <br />improvements in rights-of-way offered for dedication to the public under an approved <br />Preliminary or final Subdivision Plat, or under an approved Preliminary or Final <br />Development Plat for which a Site Preparation Permit also has been approved. <br /> <br />Section 1.6.6.2 <br /> <br />Timing of Public Improvements <br /> <br />City of San Marcos, Texas <br /> <br />1-109 <br /> <br />Land Development Code - Final <br />
