<br />Chapter 1 Development Procedures - Article 2 Authority oj Decision-Makers <br /> <br />(9) Petition for relief from a dedication or construction requirement. <br /> <br />(b) Initial Decision-Maker. The Engineering Director is the initial decision-maker for the <br />following types of development applications and relief petitions, subject to appeal as <br />provided in this Chapter I: <br /> <br />(1) Application for approval of construction plans, and all related construction <br />management tasks, including without limitation approval of a contract for <br />public improvements; <br /> <br />(2) Application for a Site Preparation Permit; <br /> <br />(3) Application for a Floodplain Permit; <br /> <br />(4) Application for a Watershed Protection Plan (Phase 1 or Phase 2, not a <br />Qualified Watershed Protection Plan); and <br /> <br />(5) Impact fee decision; and <br /> <br />(6) Vested rights petition for any decision for which the Director is the initial <br />decision-maker. <br /> <br />(c) Floodplain Administrator. The Engineering Director is the Floodplain Administrator <br />for the City and shall carry out the following duties and responsibilities: <br /> <br />(1) Maintain and hold open for public inspection all records pertaining to this <br />article. <br /> <br />(2) Review permit applications to determine whether proposed building sites will <br />be reasonably safe from flooding. <br /> <br />(3) Review and approve or deny applications for Floodplain Permits required by <br />this article. <br /> <br />(4) Provide forms for post-construction elevation certificates and receive <br />completed certificates, as needed, to assist property owners in meeting the <br />requirements for participation in the National Flood Insurance Program. <br /> <br />(5) Review and make recommendations regarding proposed appeals and letters of <br />map revision initiated by property owners. <br /> <br />(6) Coordinate the local review of proposed new flood insurance studies and <br />flood insurance rate maps for the City as required by the Federal Emergency <br />Management Agency. <br /> <br />City oj San Marcos, Texas <br /> <br />1-14 <br /> <br />Land Development Code - Final <br /> <br />, <br /> <br />It <br /> <br />~ <br />
