<br />Chapter 1 Development Procedures - Article 4 General Legislative Procedures <br /> <br />Section 1.4.1.3 <br /> <br />Processing of Application and Decision <br /> <br />(a) Submittal. A petition for amendment of the Master Plan shall be submitted to the <br />Planning Director at least 20 days before the date of any public hearing before the <br />Planning and Zoning Commission. <br /> <br />(b) Notice and Hearing. The Planning and Zoning Commission shall hold a public <br />hearing on the petition in accordance with Article 3, Division 3 of this Chapter 1 after <br />receiving the report and recommendation of the Director. <br /> <br />(c) Commission Recommendation. The Planning and Zoning Commission shall make a <br />recommendation regarding the proposed Master Plan amendment(s) to the City <br />Council. The Planning and Zoning Commission may recommend approval, approval <br />with conditions, or denial of the petition for a Master Plan amendment. <br /> <br />(d) Decision by Council. Following receipt of the recommendation of the Planning and <br />Zoning Commission, the City Clerk shall schedule a public hearing to determine <br />whether to approve and adopt the amendment(s). The City Clerk shall cause notice of <br />the hearing to be published in accordance with Article 3, Division 2 of this Chapter 1. <br />After the public hearing is closed, the Council may approve, reject or modify the <br />requested amendments by adoption of an ordinance. The maps of the Master Plan <br />shall be amended to reflect the Council's decision as needed. <br /> <br />Section 1.4.1.4 <br /> <br />Criteria for Approval <br /> <br />The Planning and Zoning Commission in making its recommendation and the City Council in <br />taking action on the request for amendment of the Master Plan shall consider the following <br />criteria: <br /> <br />(a) For text amendments, whether the amendment is consistent with other policies of the <br />Master Plan, taking into account the nature of any proposed map amendment <br />associated with the text amendment; <br /> <br />(b) For map amendments, whether the amendment is consistent with the policies of the <br />Master Plan that apply to the map being amended, taking into account the nature of <br />any proposed land use associated with the map amendment; and <br /> <br />(c) Whether the amendment promotes the orderly and efficient growth and development <br />of the community and furthers the public health, safety and general welfare of the <br />City. <br /> <br />Section 1.4.1.5 Planning and Zoning Commission's Role in Reviewing the Master Plan <br /> <br />City of San Marcos, Texas <br /> <br />1-42 <br /> <br />Land Development Code - Final <br /> <br />, <br /> <br />It <br /> <br />'- <br />
