S\1I'm TO JAY WILLIAMEON, TRUSTEE DATED JUNE <br /> 5,1985, AND RECORDED IN VOLUME 529, PAGE 250, HAYS <br /> COUNTI DEED RECORDS, AND '!HAT TRACT DESCRIBED AS 25% OF <br /> 62.235 ACRES IN A DEED FROM SECOND BAPTI ST CHURCH TO <br /> JAY \VILLIAMEON, TRUSTEE, DATED JUNE 4, 1985 AND RECORDED <br /> IN VOLUME 529, PAGE 254, HAYS COUNTI DEED RECORDS, SAID <br /> PROPERTI BEING LOCATED WI'IROUT '!HE CORFORATE LIMITS OF <br /> '!HE CITI OF SAN ~1ARCOS, PUT \rVI'!HIN SAID CITI' S TI'IJO (2) <br /> MILE EXTRATERRITORIAL JURI SDICTION AND LOCATED ON 'mE <br /> EOU'IHWEST SIDE OF F.M. 621, FROM row DENSITI <br /> RESIDENTIAL USE TO MEDIUM DENSITI RESIDENTIAL USE, HIGH <br /> DENSITI RESIDENTIAL USE, RJBLIC USE, PERMANENT OPEN <br /> SPACE USE, AND COMMERCIAL USE; AND D EC LARI NG AN <br /> EFFECTIVE DATE. <br /> ~'\7HEREAS, on July 16, 1985, the Joint Planning and <br /> Zoning Commissions of the City of San Marcos held a public hearing <br /> regarding a request to amend the Future Land Use Plan (Map) of the <br /> Master Plan from low Ißnsity Residential Use to Medium Ißnsity <br /> Residential Use, High Ißnsity Residential Use, Public Use, Permanent <br /> Open Space Use, and Commercial Use for approximately 25.3 acres of <br /> land out of the J .M. Veramendi Survey No.1, and the J.M. Veramendi <br /> Slrvey No. 1 and the B.O'Kane Survey, Hays County, Texas: and, <br /> ~'JHEREAS, subsequent to said public hearing on said date, said <br /> Commissions did, on July 16,1985, consider said request and <br /> voted to approve the same and have recommended that such request be <br /> approved by the City Council of said City; and, <br /> ~'\7HEREAS, said City Council held a public hearing on the 10 day <br /> of Iebru.a.ry 1986, regarding such request; and, <br /> WHEREAS, all requirements of the Master Plan pertaining to <br /> amendments have been met; and, <br /> WHEREAS, said City Council hereby finds and determines that the <br /> adoption of the following resolution is in the interest of the public <br /> health, morals, welfare and safety; now, therefore, <br /> BE IT REEOLVED BY 'IRE CITI COUNCIL OF 'IRE CITI OF SAN MARCOS, TEXAS: <br /> PART 1. That the land uses for those tracts shown on Exhibit <br /> 1, which is attached hereto and incorporated herein for all purposes, <br /> as approximately 8.52 acres Medium Ißnsity Residential use, <br /> approximately 7.66 acres High Ißnsity Residential use, approximately <br /> 3.14 acres Commercial Use, approximately 3.91 acres Public Use, and <br /> approximately 2.07 acres Permanent Open Space use, which are located <br /> without the corporate limits of the City of San Marcos but within said <br /> City's two (2) mile extraterritorial jurisdiction and on the southwest <br /> side of F.M. 621 in Hays County, 'Texas, which are in an area presently <br /> shown on the Future Land Use Plan (Map) of the Master Plan of the City <br /> of San ~~rcos as low Ißnsity Residential shall henceforth be shown on <br /> said Map as set forth in said Exhibit 1. <br /> PART 2.
