<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SæTION 1 OF ORDINANCE 1984-70
<br />ADOPTED JUNE 13, 1984 DæLARING A BUILDING MORATORIUM 10
<br />.'- DELETE THEREFROM. PLANNING UNITS 1, 2, 3, 4, 5, 52 AND 53
<br />~ EFFæTIVE APRI L 1, 1986; TO DELETE THEREFROl'1 UIDN PASSAGE
<br />OF THIS ORDINANCE A IDRTION OF PLANNING UNITS 5 AND 53;
<br />AND PROVIDING FOR AN EFFæTIVE DATE.
<br />
<br />WHEREAS, the City of San Marcos has resolved or is in the process
<br />of resolving most of the serious problems concerning inadequate public
<br />improvements and facilities within certain areas of the City that have
<br />been affected by that moratorium adopted on June 13, 1984; and,
<br />
<br />WHEREAS, pursuant to Section 4 of Ordinance 1984-70 adopted June
<br />13, 1984, a citizen advisory corrmittee was established by the City
<br />Council to advise Council on solutions to problems discussed in the
<br />City Manager's report attached to said Ordinance; and,
<br />
<br />WHEREAS, said citizen advisory committee has recommended to
<br />Council that the building moratorium in portions of planning units 5
<br />and 53 should be lifted since the sewerage problem necessitating a
<br />moratorium in portions of planning units 5 and 53 have been identified,
<br />the costs for improvements have been determined and wastewater
<br />improvements in said planning units have been funded, street and
<br />drainage improvements will be made on a high priority basis as part of
<br />a comprehensive City Capital Improvement Pro;Jram in the future,
<br />development proposals that cannot be adequately served by fust Road or
<br />that will exacerbate existing traffic problems on fust Road will not be
<br />approved or authorized, unless a fee is paid to mitigate adverse
<br />traffic impacts; and,
<br />
<br />WHEREAS, portions of planning units 5 and 53 are not served by the
<br />University-Main Sewer Interceptor, the poor condition of which
<br />necessitates continuing a moratorium in the remainder of planning units
<br />5 and 53 and planning units 1, 2,3,4 that are served by the
<br />University-Main Sewer Interceptor; but,
<br />
<br />WHEREAS, fust Road is a substandard road which must be improved,
<br />and that development in portions of planning units 5 and 53 that are
<br />not served by the University-Main Sewer Interceptor will add traffic
<br />to fust Road, and therefore adversely impact the substandard fust
<br />Road, and,
<br />
<br />WHEREAS, said citizen advisory corrmittee has recommended that new
<br />development in portions of planning units 5 and 53 should bear its
<br />share of the cost of improvements of fust Road, and,
<br />
<br />WHEREAS, the citizen advisory committee has recormœnded that
<br />building pennits and subdivision plats that would have direct access
<br />to fust Road should not be approved unless that new development bears
<br />its share of the costs of improvements of Post Road, now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN !\1ARCOS,
<br />T&XAS :
<br />
<br />SæTION 1. That Section 1 of Ordinance 1984-70, adopted June 13,
<br />1984 and amended on December 3,1984, be amended further to delete
<br />therefrom planning units 1,2,3,4,5,52 and 53 effective April 1,
<br />1986.
<br />
<br />SæTION 2. That Section 1 of Ordinance 1984-70, adopted June 13,
<br />1984, and as amended on December 3, 1984, be amended to delete
<br />therefrom those portions of planning units 5 and 53 not served by the
<br />University-Main Sewer Interceptor; otherwise, the remainder of said
<br />Section to remain in full force and effect.
<br />
<br />SECTION 3. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage, and it shall be published in a newspaper of
<br />general circulation in the area as required by the Charter of the City
<br />of San Marcos, Texas.
