<br /> its O\~lNEH, may be redeemed upon the payment of reasonable <br /> charges as determined by the ADMINISTRA'I'OR and incurred by <br /> the CITY or its agents for removal, transportation, storage, <br /> and administrative costs resulting from the impoundment. <br /> All SIGNS which are not redeemed within 60 calendar days <br /> shall be subject to disposal in the manner provided by law <br /> for the disposition of unclaimed property. SIGNS sha.ll be <br /> removed and impounded in accordance with the following <br /> conditions: <br /> 1. Any SIGN unlawfully situated in the right-of-way of a <br /> public street or on a utility pole, or unlawfully <br /> located in a required corner SIGHT-TRIANGLE, any SIGN <br /> overhanging a public right-of-way which is determined <br /> to be dangerous or defective so as to be an immediate <br /> safety hazard, or any TEMPORARY SIGN exceeding the <br /> permitted size or time limits, may be removed without <br /> notice. <br /> 2. Any SIGN unlawfully placed on public property other <br /> than right'-of-way, any improperly anchored SIGN, any <br /> ABANDONED SIGN, or any PORTABLE SIGN exceeding the <br /> permitted size limits may be removed if the violation <br /> is not voluntarily corrected by the responsible party <br /> within 3 working days of receipt of notification from <br /> the ADMINISTRATOR. Notices for removal shall be sent <br /> by registered mail or personally delivered to the <br /> OWNER. <br /> SßG. .þ:::p.App..eaJ . and.. Jlar.ia.ß.G.es <br /> 1. Appeal. Any PERSON may appeal a determination of the <br /> ADMINISTRATOR to the Zoning Board of Adjustments in <br /> accordance with the requirements of Sec. 40 of the <br /> General Zoning Ordinance. <br /> t) Variances. <br /> Lo. <br /> a. Any PERSON may apply for a variance to any <br /> provision of this ordinance to the Zoning Board of <br /> Adjustments. <br /> b. If a variance is sought to the terms of this <br /> ordinance, the following special provisions shall <br /> apply: <br /> ( 1) Subsections b. and g. of Section 40 of the <br /> General Zoning Ordinance shall not be <br /> applicable. <br /> ( 2) In determining a variance request the Zoning <br /> Board of Adjustments shall consider any <br /> evidence offered which shows or demonstrates <br /> (a) that the purposes of advertising will be <br /> defeated without a variance to the <br /> requirements of this section and/or <br /> (b) that the business in question has no <br /> reasonable means available to it to <br /> attract business other than the means <br /> for which the variance is requested. <br /> -22- <br />
