R. Y . M ., INC. <br /> PERTAINING TO THE APPROVAL BY 'IRE ZONING COMMISSION OF <br /> SAID CITY OF A SPErl FIC USE PERMIT TO B.R.Y.M., INC. <br /> FDR THE OPERATION OF A BAR KNaVN AS "FOOTLOOSE" IN SAID <br /> CITY 'ill ESTABLISH AN ALTERNATIVE PROCEDURE FDR THE <br /> IHPLEMENTATION OF THE roSTING OF A CASH POND 'ill COVER <br /> APPROVED CLAIMS FOR PROPERTY DN'1AGE ARISIN::: FROH THE <br /> OPERATION OF SAID BAR; AUTHORIZING THE MAYOR 'ill EXOCUTE <br /> SAID AGREEJv1ENT ON BEHALF OF SAID CITY; AND DECLARING AN <br /> EFFErTIVE DATE. <br /> ~lliEREAS, the Zoning Commission of the City of San Marcos, Texas, <br />pursuant to authority granted it in Article 35(H)(5) of the Code of <br />Ordinances of said City conditioned its approval of a specific use <br />permit to B.R.Y.!\1., Inc. to operate a bar known as ., Footloose" <br />located at the intersection of San Antonio and Guadalupe Streets in <br />said City upon the posting by B.R.Y.M., Inc. of a One Thousand Ibllar <br />($1,000.00) cash bond with the Chamber of Comrrerce to cover approved <br />claims for property damage arising from t~e operation of said bar; <br />and, <br /> }~EREAS, B.R.Y.M., Inc. accepted such condition, but the Chamber <br />of Cormnerce has declined to accept such txmd or establish the procedure <br />for accepting and approving claims thereunder; now, therefore, <br /> BE IT REEDLVED BY 'IHE CITY COUNCIL OF 'IHE CITY OF SAN MARCOS, <br />TEXAS: <br /> PART 1. That the terms and conditions of that proposed agreement, <br />a copy of which is attached hereto and incorporated herein for all <br />purposes, bet\-;een said City and B.R.Y.~1., Inc. pertainin;j to the <br />approval by the Zoning Commission of said City of a specific use permit <br />to B.R.Y.M., Inc. for the operation of a bar knoi,olJl as "Footloose" in <br />said City, to establish an alternative procedure for the implementation <br />of the posting of a cash bond to cover approved claims for property <br />damages adsing from the operation of said bar, are hereby in all <br />th ings approved. <br /> PART 2. That the Mavor of said City is hereby authorized to <br />execute said agreement. <br /> PART 3.
