<br />THE STATE OF TEXAS § <br /> § SPECIAL WARRANTY DEED <br />COUNTY OF HAYS § <br />KNOW ALL PERSONS BY THESE PRESENTS: <br /> THAT the CITY OF SAN MARCOS, TEXAS, a municipal corporation <br />organized and existing by and under the laws of -the State of Texas, as <br />TRUSTEE for itself, the State of Texas, the County of Hays, and the San <br />Marcos Consolidated Independent School District, for and in <br />consideration of the sum of ONE THOUSAND FIVE HUNDRED DOLLARS <br />($1,500.00) and other valuable consideration to the undersigned paid by <br />the Grantees herein named, the receipt of which is hereby acknowledged, <br />has GRANTED, SOLD AND CONVEYED, and by these presents does GRANT, SELL <br />.2lliD CONVEY unto FRAi\fCO BENITES LOPEZ and wife, LUPE SUAREZ LOPEZ of <br />~20 Parker Drive, San Marcos, Hays County, Texas 78666, all of the <br />following described real property in Hays County, Texas, to-I¡.¡i t: <br /> Lot 6, Block 1, of the First Section Of Victory Gardens, a <br /> subdivision in the City of San Marcos, Texas, as shown on the <br /> map or plat thereof recorded in Volume 128, Page 46, of the <br /> Deed Records of Hays County, Texas; <br /> This conveyance is made and accepted subject to any and all <br />conditions and restrictions, if any, relating to the hereinabove <br />described property to the extent, and only to the extent, that the same <br />may still be in force and effect, shown of record in the Office of the <br />County Clerk of Hays County, Texas; <br /> TO HAVE AND TO HOLD the above-described premises, together with <br />all and singular the rights and appurtenances thereto in an~vise <br />elonging, unto the said Grantees, their heirs and assigns forever; and <br />_!RANTOR does hereby bind itself, its successors and assigns, to WARRANT <br />AND FOREVER DEFEND all and singular the said premises unto the said <br />Grantees, their heirs and assigns, against every person whomsoever <br />lawfully claiming or to claim the same or any part thereof, by, through <br />or under it, but not otherwise. <br />
