<br /> 59 <br />STATE OF TEXAS § <br />COUNTY OF HAYS § <br /> MAINTENANCE AGREEMENT <br /> THIS AGREEMENT, entered into at San Marcos, Texas, on the 15 <br />day of April , 19 86 , by and between the CITY OF SAN MARCOS, <br />TEXAS, City Hall, 630 East Hopkins Street, San Marcos, Texas 78666, <br />hereinafter called "City" and the LOWER COLORADO RIVER AUTHORITY, a <br />utility company hereinafter called "LCRA" is as follows: <br /> City engages LCRA to perform maintenance of the thoroughfare <br />lighting on IH-35 in San Marcos, Hays County, Texas. <br /> City and LCRA, for mutual consideration hereinafter set forth, <br />agree as follows: <br /> A. LCRA will charge for this maintenance consistent with the <br /> current standard street light billing procedure which is <br /> attached hereto and incorporated by reference herein as <br /> Exhibit A. <br /> B. LCRA shall provide bulbs, ballasts, photo cells and oil <br /> switches in the course of maintaining street lights. City <br /> shall be responsible for providing all other parts. <br /> C. Maintenance of the underground secondary will be the <br /> responsibility of the City. <br /> D. LCRA shall schedule a day or days (depending on need) in each <br /> month for the performance of maintenance. LCRA shall inform <br /> the City when LCRA needs City police support and signs in <br /> accordance with Texas State Highway Department Regulations. <br /> In the performance of this Agreement, LCRA, its contractors and <br />subcontractors shall comply with all local, state and federal laws. <br /> This Agreement shall be governed by the laws of the State of <br />Texas. <br /> IN WITNESS WHEREOF, the parties hereto have accepted, made and <br />executed this Agreement upon the terms, conditions, and provisions <br />above stated, the day and year first above written. <br />LOWER COLORADO RIVER AUTHORITY CITY OF SAN MARCOS, TEXAS <br />(LCRA) (CITY) <br /> \ <br />By: By: ~~ c-, <br /> Signature Si ria t ure..)
