59 STATE OF TEXAS § COUNTY OF HAYS § MAINTENANCE AGREEMENT THIS AGREEMENT, entered into at San Marcos, Texas, on the 15 day of April , 19 86 , by and between the CITY OF SAN MARCOS, TEXAS, City Hall, 630 East Hopkins Street, San Marcos, Texas 78666, hereinafter called "City" and the LOWER COLORADO RIVER AUTHORITY, a utility company hereinafter called "LCRA" is as follows: City engages LCRA to perform maintenance of the thoroughfare lighting on IH-35 in San Marcos, Hays County, Texas. City and LCRA, for mutual consideration hereinafter set forth, agree as follows: A. LCRA will charge for this maintenance consistent with the current standard street light billing procedure which is attached hereto and incorporated by reference herein as Exhibit A. B. LCRA shall provide bulbs, ballasts, photo cells and oil switches in the course of maintaining street lights. City shall be responsible for providing all other parts. C. Maintenance of the underground secondary will be the responsibility of the City. D. LCRA shall schedule a day or days (depending on need) in each month for the performance of maintenance. LCRA shall inform the City when LCRA needs City police support and signs in accordance with Texas State Highway Department Regulations. In the performance of this Agreement, LCRA, its contractors and subcontractors shall comply with all local, state and federal laws. This Agreement shall be governed by the laws of the State of Texas. IN WITNESS WHEREOF, the parties hereto have accepted, made and executed this Agreement upon the terms, conditions, and provisions above stated, the day and year first above written.
