<br /> ORDINANCE 1986-35
<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, CANVASSING RETURNS AND
<br /> DECLARING RESULTS OF THE SPECIAL ELECTION HELD
<br /> ON APRIL 19, 1986 FOR THE PURPOSE OF ELECTING
<br /> A CITY COUNCIL MEMBER, PLACE ONE; AND,
<br /> DECLARING AN EMERGENCY.
<br /> WHEREAS, the City Council of the City of San Marcos, Texas,
<br />by ordinance duly enacted on March 24, 1986, and as amended on
<br />April 7, 1986 and April 14, 1986, ordered that a special election
<br />be held on April 19, 1986 for the purpose of electing a city
<br />council member, place one; and,
<br /> WHEREAS, notice of said election was duly published in the
<br />San Marcos Daily Record on April 11, 1986; and,
<br /> WHEREAS, copies of said notice were duly posted at each city
<br />election precinct polling place prior to said election, and a copy
<br />of same was posted on the bulletin board at City Hall on April 11,
<br />1986; and,
<br /> WHEREAS, said election was duly and legally held on the 19th
<br />day of April, 1986, in conformity with the election laws of the
<br />State of Texas, and the results of said election have been
<br />certified and returned by the proper judges and clerks thereof;
<br />and,
<br /> WHEREAS, the City Council of the City of San Marcos, Texas,
<br />with the following members present: Bill Coddington, Gerald G. Farr,
<br />J. E. Younger, Fred Guerra, Betty Jane Kissler and William C. Nicola
<br />
<br />has today considered the returns of said special election held on
<br />the 19th day of April, 1986; and,
<br /> WHEREAS, it appears to the Council, and the Council so finds,
<br />that the said election was in all respects lawfully held; and,
<br /> WHEREAS, it appears to the Council, and the Council so finds,
<br />that the tabulation of the results of said election is correct;
<br />now, therefore,
<br /> BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS:
<br /> SECTION 1. That the special City election of April 19,
<br />1986 was duly called, that notice of said election was given in
<br />accordance with law, and that said election was held in accordance
<br />with law.
<br /> SECTION 2. That the tabulation of votes cast in the
<br />special election held on April 19, 1986 for the purpose of
<br />electing a city council member, place one, made and certified to
<br />by the City Secretary of the City of San Marcos, a copy of which
<br />is attached hereto and made a part hereof, be, and the same is
<br />hereby, adopted as the official tabulation of the votes cast at
<br />said election and that said tabulation be filed and recorded in
<br />the official records of the City of San Marcos as the official
<br />canvass of said election.
<br /> SECTION 3. That the said official canvass of the returns
<br />of said election reflects the following:
<br /> A. That the official canvass of the returns of said
<br /> election reflects that the following person was duly
<br /> elected City Council Member, Place One, of the City of
<br /> San Marcos:
