<br />80 <br /> <br />Ordinance 1986-39 <br /> <br />ì~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />~ OF SAN ~ffiRCOS, TEXAS, REPEALING SECTIONS <br />2-73(d)(l) AND (2) OF THE CODE OF ORDINANCES, <br />ADOPTING NEW SECTIONS 2-73(d)(l) AND (2) OF <br />THE SAN MARCOS CODE OF ORDINANCES TO PROVIDE <br />FOR PRO SE REPRESENTATION OF COUNCIL MEMBERS <br />IN MUNICIPAL COURT, PROVIDING FOR A SPECIAL <br />JUDGE, PROVIDING FOR PRO SE REPRESENTATION OF <br />CITY OFFICIALS AND EMPLOYEES, AND PROHIBITING <br />THE REPRESENTATION OF OTHERS BY ALL CITY <br />OFFICERS AND EMPLOYEES; AND, DECLARING AN <br />EFFECTIVE DATE. <br /> <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Sections 2-73(d)(l) and (2) of the San <br />Marcos Code of Ordinances are hereby repealed. <br /> <br />SECTION 2. That new section 2-73(d)(l) of the San Marcos <br />Code of Ordinances is adopted to read as follows: <br /> <br />(d) <br /> <br />(1) No city council member, including the mayor, <br />shall knowingly represent any private person <br />other than himself or herself. If a council <br />member elects to have a trial in Municipal <br />Court, the council, without the participation <br />of the affected council member, shall appoint <br />a special judge to preside over the trial. <br /> <br />SECTION 3. That new section 2-73(d)(2) of the San Marcos <br />Code of Ordinances is adopted to read as follows: <br /> <br />(2) No city officer or employee shall knowingly <br />represent any private person other than <br />himself or herself including any member of his <br />or her immediate family or any group or <br />interest. <br /> <br />SECTION 4. That this Ordinance shall be in effect ten <br />(10) days from and after its passage, and it shall be published in <br />a newspaper of general circulation in the area as required by the <br />Charter of the City of San Mrcos, Texas. <br /> <br />PASSED AND APPROVED on first reading March 24, 1986. <br /> <br />PASSED AND APPROVED on second reading April 14, 1986. <br /> <br />PASSED, APPROVED AND ADOPTED April 28, 1986. <br /> <br /> <br /> <br /> <br /> <br /> <br />Attest: <br /> <br /> <br />LJ W4II ~ <br /> <br />Janis K.
