19 Regular Meeting May 12, 1986 Page 11 Mayor Younger introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE ABANDONMENT AND RELEASE OF A SEWERLINE EASEMENT AND TEMPORARY CONSTRUCTION EASEMENT PREVIOUSLY GRANTED TO SAID CITY ON, OVER AND ACROSS A PORTION OF THAT PROPERTY LOCATED IN THE VICINITY OF AQUARENA SPRINGS IN EXCHANGE FOR A NEW SEWERLINE EASE- MENT AND TEMPORARY CONSTRUCTION EASEMENT ON, OVER AND ACROSS ANOTHER PORTION OF SAID PROPERTY¡ AUTHORIZING THE MAYOR TO EXECUTE THE INSTRUMENT EVIDENCING SAID ABANDON- MENT AND RELEASE; AND DECLARING AN EFFECTIVE DATE. Mr. Farr moved for adoption of the Resolution and Ms. Kissler seconded the motion. The City Secretary was advised to complete the two blanks in Part 1 of the Resolution with the date of May 7, 1986. The Council voted unanimously for adoption of the Resolution. Mayor Younger introduced for consideration a request by Ivar Gunnarson to be exempted from that Ordinance adopted July 29, 1985 declaring a moratorium on new off-premise signs. Jeff Hill, representing Mr. Gunnarson, stated there were two sign structures on the West side of IH35 South of San Narcos in question. Mr. Hill reviewed the problems Mr. Gunnarson faced by being advised the signs would be outside the City limits when in reality they were inside the City limits (an annexation had taken place which included the property in question). Mr. Hill advised Mr. Gunnarson had acted in good faith and that he would be financially impacted by not being allowed to utilize his two signs. Mayor Younger moved to grant Mr. Gunnarson exemption for his two signs and Mr. Coddington seconded the motion, which passed unani- mously. Mayor Younger introduced for cons~deration authorization to bid Post Road Overlay Improvements. Ms. Kissler moved for authorization to bid and Mr. Nicola seconded the motion. Mayor Younger requested a change order be added to round the corners from Lime Kiln onto Post Road. The Council voted unanimously for authorization to bid. Mayor Younger introduced for consideration approval in the amount of $4,000.00 to partially fund a Rural Water Supply Study by Guadalupe- Blanco River Authority. David Welch of GBRA advised the Council the study would cost approximately $25,000.00. Surrounding cities and water companies have been requested to contribute for the cost of the study, and thinks there will be participation of eight for the funding. Mr. Welch stated the study will be for surface water only and once the study begins, which will be shortly, it will take approxi- mately four months to complete. The Council voted unanimously for approval of funding for the study (Mr. Coddington not present to vote on this item). Ms. Kissler moved the Council adjourn into Executive Session pursuant to Article 6252-17, §§2(d), (f) and (g), V.A.C.S., to discuss matters where the duties of the City Attorney to the City pursuant to the Code of Professional Responsibility of the State Bar of Texas clearly con- flicts with Article 6252-17 (Municipal Court prosecution; LCRA); pur- chase of real property; employment of a public officer or employee (Municipal Court Judges); evaluation of a public officer or employee (Council Appointees); and duties of a public officer or employee (re: insurance), respectively, and Mr. Farr seconded the motion, which passed unanimously (Mr. Coddington not present to vote on this item- 11: 43 p.m.) .
