<br /> 19 <br />Regular Meeting May 12, 1986 Page 11 <br />Mayor Younger introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING THE ABANDONMENT AND RELEASE <br /> OF A SEWERLINE EASEMENT AND TEMPORARY CONSTRUCTION <br /> EASEMENT PREVIOUSLY GRANTED TO SAID CITY ON, OVER AND <br /> ACROSS A PORTION OF THAT PROPERTY LOCATED IN THE VICINITY <br /> OF AQUARENA SPRINGS IN EXCHANGE FOR A NEW SEWERLINE EASE- <br /> MENT AND TEMPORARY CONSTRUCTION EASEMENT ON, OVER AND <br /> ACROSS ANOTHER PORTION OF SAID PROPERTY¡ AUTHORIZING THE <br /> MAYOR TO EXECUTE THE INSTRUMENT EVIDENCING SAID ABANDON- <br /> MENT AND RELEASE; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Farr moved for adoption of the Resolution and Ms. Kissler seconded <br />the motion. The City Secretary was advised to complete the two blanks <br />in Part 1 of the Resolution with the date of May 7, 1986. The Council <br />voted unanimously for adoption of the Resolution. <br />Mayor Younger introduced for consideration a request by Ivar Gunnarson <br />to be exempted from that Ordinance adopted July 29, 1985 declaring a <br />moratorium on new off-premise signs. Jeff Hill, representing Mr. <br />Gunnarson, stated there were two sign structures on the West side of <br />IH35 South of San Narcos in question. Mr. Hill reviewed the problems <br />Mr. Gunnarson faced by being advised the signs would be outside the <br />City limits when in reality they were inside the City limits (an <br />annexation had taken place which included the property in question). <br />Mr. Hill advised Mr. Gunnarson had acted in good faith and that he <br />would be financially impacted by not being allowed to utilize his two <br />signs. Mayor Younger moved to grant Mr. Gunnarson exemption for his <br />two signs and Mr. Coddington seconded the motion, which passed unani- <br />mously. <br />Mayor Younger introduced for cons~deration authorization to bid Post <br />Road Overlay Improvements. Ms. Kissler moved for authorization to <br />bid and Mr. Nicola seconded the motion. Mayor Younger requested a <br />change order be added to round the corners from Lime Kiln onto Post <br />Road. The Council voted unanimously for authorization to bid. <br />Mayor Younger introduced for consideration approval in the amount of <br />$4,000.00 to partially fund a Rural Water Supply Study by Guadalupe- <br />Blanco River Authority. David Welch of GBRA advised the Council the <br />study would cost approximately $25,000.00. Surrounding cities and <br />water companies have been requested to contribute for the cost of <br />the study, and thinks there will be participation of eight for the <br />funding. Mr. Welch stated the study will be for surface water only <br />and once the study begins, which will be shortly, it will take approxi- <br />mately four months to complete. The Council voted unanimously for <br />approval of funding for the study (Mr. Coddington not present to vote <br />on this item). <br />Ms. Kissler moved the Council adjourn into Executive Session pursuant <br />to Article 6252-17, §§2(d), (f) and (g), V.A.C.S., to discuss matters <br />where the duties of the City Attorney to the City pursuant to the Code <br />of Professional Responsibility of the State Bar of Texas clearly con- <br />flicts with Article 6252-17 (Municipal Court prosecution; LCRA); pur- <br />chase of real property; employment of a public officer or employee <br />(Municipal Court Judges); evaluation of a public officer or employee <br />(Council Appointees); and duties of a public officer or employee (re: <br />insurance), respectively, and Mr. Farr seconded the motion, which <br />passed unanimously (Mr. Coddington not present to vote on this item- <br />11: 43 p.m.) . <br />
