<br /> FIFTEEN FOOT (15') WIDE ALLEY IN THE ~^J.A. THOI'1PSJN 's
<br /> ADDITION 10 THE CITY OF SAN MARCOS, TEXAS AT\1D AN ALLEY
<br /> IN THE ROSE HILL ADDITION 10 THE CITY OF SAN MARCOS,
<br /> TEXAS; AUTHORI ZING THE MAYOR OF SAID CITY 10 EXECUTE A
<br /> SPECIAL ~^JARRANTY DEED; REFLECTING PAYMENT OF THE FAIR
<br /> MARKET VALUE OF $ 9 15 . 0 0; PROVIDING FOR THE REVERSION OF
<br /> FEE IN SAID LAND; AND DECLARI~X; AN EMERGENCY.
<br /> WHER&~S, a portion of an alley fifteen (15) feet in width on the
<br /> northwest side of the "v.A. Thompson's Addition to the City of
<br /> San Marcos, the plat of said addition being recorded in Volume 54,
<br /> Page 630, Hays County Deed Records, was and is dedicated to public use
<br /> on said plat; and,
<br /> vJHEREAS, an alley twenty (20) feet in width lœated in the Rose
<br /> Hill Addition to the City of San Marcos, the plat of said addition
<br /> be in] recorded in Volume 58, Page 396 of the Deed Records of Hays
<br /> County, Texas, was and is dedicated to public use on said plat; and,
<br /> ~7HEREAS, the City of San Marcos has been requested by Southwest
<br /> Texas Sta te University to abandon said alley and said portion of an
<br /> alley; and,
<br /> vJHEREAS, said City has previously, by ordinances duly adopted
<br /> on February 10,1949 and April 22,1985, abandoned all of the streets
<br /> and alleys \.vi thin the said W.A. Thompson's Addition except the
<br /> portion of the alley on the northwest side of said Addition
<br /> requested by Southwest Texas State University to be abandoned, said
<br /> portion being more particularly described hereinbelow; and
<br /> v,JHEREAS, the City of San Marcos has duly determined that the
<br /> Sta te of Texas, for the use and benefit of Southwest Texas State
<br /> University, is the sole ovmer of all property abutting said alley and
<br /> said portion of an alley within said additions; and,
<br /> yiIHEREAS, the City Council of the City of San Marcos, Texas, has
<br /> determined that it is in the public interest to abandon said
<br /> alley and said portion of an alley; and,
<br /> Î^JHERE~S, the State of Texas, by and through Southwest Texas State
<br /> University, has executed a release, discharging said Ci ty from any
<br /> damages œcasioned by said vacation and abandornœnt; and,
<br /> v'JHEREAS, the City of San Marcos has determined by appraisal that
<br /> the fair market value of the alley in said Rose Hill Addition
<br /> is $395.00 ,and tha t the fair market value of said portion of
<br /> an alley in said v\1.A. Thompson's Addition is $ 5 2 0 . 0 0, and the
<br /> same has previously been deposited with said City; now,
<br /> therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCI L OF THE CITY OF SAt\! [\1ARCOS,
<br /> TEXAS:
<br /> SECTION 1. That a portion of an alley fifteen (15) feet in width
<br /> on the northwest side of the W.A. Thompson's Addition to the City of
<br /> San Marcos, the plat of said subdivision being recorded in Volume 54,
<br /> Page 630, Deed Records of Hays County, Texas, being H'Ore particularly
<br /> described by metes and bounds as follows:

<br /> DESCRIPTION OF A 0.209-ACRE STRIP OF LAND BEING A IS-FOOT ALLEY
<br /> IN THE W.A. THOMPSJN ADDITION 10 THE CITY OF SAN MARCOS,
<br /> HAY S COUNTY, TEXAS, AS SHOVVN ON A PLAT RECORDED IN VOLUME 54,
<br /> PAGE 630 OF THE DEED RECORDS OF HAYS COUNTY, TEXAS; SAID
<br /> 0.209-ACRE STRIP BEII\G MORE PARTICULARLY DESCRIBED AS FOLWWS:
