<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS, Al\1ENDING SECTION 3 OF THAT ORDINANCE vl7HICH
<br /> REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br /> S'IRUCTIJRES AND LAND, DATED JUNE 13,1984 (VOL. 66) BY
<br /> CHANGING THE ZONING OF LOT 15 OF THE
<br /> ffiUTR END ADDITION, AN ADDITION IN THE CITY OF SAN MARCOS
<br /> AS SHaNN ON THE MAP OR PLAT THEREOF RECORDED IN VOLUME
<br /> 55, PAGE 601, HAYS COUNTY DEED RECORDS, A/K/A 398
<br /> RAILROAD STREET, FRO-VI "]VI" (SINGLE, DUPLEX, AND NEIGHIDRHOOD
<br /> BUSINESSES DISTRICT) 'ill "R-1" (SINGLE-FAMILY DWELLING
<br /> DISTRICT) AND DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, on February 4, 1986, the Zoning Commission of the City of
<br />S:m Marcos held a public hearing regarding a request to change the
<br />zoning from "M" (Single, Duplex, and Neighborhood Businesses District)
<br />to "R-l" (Single-Family IMelling District) of IDt 15 of the South
<br />End Addition, a subdivision in said City; and,
<br /> 'tilHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on February 4,1986, consider said request and the
<br />Zoning Commission voted to grant the same and has recomrœnded that
<br />such request be granted by the City Council of said Ci ty ,
<br />and,
<br /> WHEREAS, said City Council held a public hearing on the 12th day
<br />of May ,1986, regarding such request; and,
<br /> WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met: and,
<br /> WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety: now, therefore,
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br /> SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently zoned "M"
<br />(Single, Duplex, and Neighborhood Businesses District) henceforth
<br />shall be rezoned "R-l" (Single-Family !)..veIling District):
<br /> LOT 15 OF THE 9)UTH END ADDITION, AN ADDITION IN
<br /> THE CITY OF SAN MARCOS AS SHCWN ON THE MAP OR PLAT THEREOF
<br /> RECORDED IN VOLUME 55, PAGE 601, HAYS COUN'IY DEED
<br /> RECORDS.
<br /> SECTI ON 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on May 19, 1986, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.
<br />PASSED, APPROVED AND ADOPTED this the 12 day of May, 1986 ,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for May 19, 1986. .
