<br /> SECTIOH III <br /> ENGINEER COMPENSATION AND WORK SCHEDULE <br /> For and in consideration of the service to be rendered by <br /> ENGINEER, the OWNER shall pay and the ENGINEER shall receive a <br /> fee as shown on the following schedule: <br /> ITEM ESTIMATED COSTS BASIS SCHEDULE <br /> A. Easement Survey $8,000 Hourly 45 Days <br /> B. Topographic Survey $10,000 Hourly 30 Days <br /> C. Engineering Design $20,000 Hourly 60 Days <br /> D. Construction Layout $3,000 Hourly Timely <br /> E. Construction Admin. $6,000 Hourly Timely <br /> F. Special Services ---- Hourly Timely <br /> ESTIMATED MAXIMUM COST $47,000 <br /> NOTES: <br /> 1. The word Days shown on the schedule means calendar days after <br /> receipt of notice to proceed. <br /> 2. It is understood the fee for any Item may overrun the <br /> estimated amount, however, the Estimated Maximum Cost will <br /> not be exceeded without prior written authorization <br /> from the OWNER. <br /> 3. All work will be billed monthly based upon the actual time and <br /> expenses expended to perform the service The actual time and <br /> expense will be charged in accordance with the hourly rate <br /> schedule sheet attached to this Agreement and identified as <br /> Exhibit "A". <br /> 4. Prior to beginning the preparation of the final design <br /> documents, the ENGINEER will prepare for the OWNER'S <br /> approval, a preliminary drawing showing the proposed project <br /> including preliminary layouts, construction cost estimate, <br /> and reasonable alternatives before the ENGINEER begins <br /> preparation of the final engineering design documents. <br /> 5. Should litigation be necessary to enforce any term or <br /> provision of this agreement or to collect any portion of the <br /> amount payable under this agreement then all litigation and <br /> collection expenses, witness fees, court costs, and <br /> attorney's fees shall be paid to the prevailing party. <br /> -4- <br />
